Договір сурогатного материнства у міжнародному приватному праві

Дисертаційна робота присвячена дослідженню відносин, що складаються у зв'язку з укладенням та виконанням договору сурогатного материнства у міжнародному приватному праві, а також відносин, які виникають або змінюються внаслідок виконання такого договору.

The dissertation is devoted to the study of the relations arising in connection with
the conclusion and performance of a surrogacy agreement in private international law, as well as the relations that arise or change as a result of the performance of such agreement.
The author establishes the legal nature of the subjective civil right to biological reproduction, the legal conditions for which are established, in particular, by concluding a surrogacy agreement. The author substantiates that such a right is a measure of a person's possible behavior with regard to the realization of the reproductive function by committing acts of active behavior aimed at natural or artificial conception (for male and female persons) and/or gestation and birth (for female persons) of offspring, as defined by the provisions of civil law. The article defines the subjective civil right to biological reproduction as a sui generis subjective right which cannot be corresponded to a subjective civil obligation of a person of the other sex (including if such a person is married to a person seeking to exercise such a right) and the exercise of which may at the same time require the counter exercise of such a right by a person of the other sex.
