The factors influencing the appointment of this type of social security are considered. One such factor is a social case. The article discusses the discussion of the positions of the scholars regarding the fact that the basis for providing social security is social risk, and the definition of "risk" and "case" from the reference literature is defined and it is noted that the basis for the implementation of social security, including assistance, is the onset of a social case, not a risk. The positions of scientists concerning the notion of "need" as a component to be analyzed in determining the right of a person to social security are given (a set of three elements: the connection with the size of the subsistence minimum; taking into account all income and property of the person; taking into account the reasons for need, which should not depend from person). One of the legal facts that affects the appointment of this social assistance is the absence of the length of the insurance period established by the legislator - the period of labor or other socially useful activity of citizens who are or were in labor relations with enterprises, institutions, organizations for which insurance contributions were paid, or the period of activity of persons equal to employees for which insurance contributions were paid, as well as other periods for which insurance contributions were paid. It also focuses on low social standards, in particular, the subsistence minimum, which is the estimated amount to help a person who is not entitled to a pension - the amount of the state social benefit is deducted based on the size of the subsistence minimum for people who have lost their ability to work. The necessity of bringing national legislation in line with international standards, streamlining the current legislation in Ukraine and taking into account real inflation processes and the needs of a person for a decent existence are stressed.
