Київ, 2024. 237 с.УДК 35.077https://ir.library.knu.ua/handle/15071834/2566У дисертації запропоновано вирішення актуального наукового завдання в галузі науки “Публічне управління та адміністрування”, яке полягає в теоретичному та науково-практичному обґрунтуванні пріоритетних напрямів взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству та розробці практичних рекомендації щодо їх вдосконалення. Перший розділ дисертації присвячено теоретико-методологічним основам запобіганню домашньому насильству. Зосереджено увагу на розвитку інституційної спроможності суб’єктів, уповноважених на запобігання та протидію домашньому насильству на національному, регіональному та місцевому рівнях. На основі аналізу наукових джерел розкрито питання сутності домашнього насильства та запобігання, доповнено класифікацію уповноважених суб’єктів у сфері запобігання, проведено аналіз інституційного забезпечення сфери запобігання домашньому насильству в Україні. У другому розділі проаналізовано нормативно-правове забезпечення взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству. Проведено аналіз стану та виявлено тенденційні проблемні питання взаємодії органів публічної влади з міжнародними організаціями на національному, регіональному та місцевому рівнях, запропоновано шляхи їх вирішення, шляхом розробки та впровадження державної стратегії взаємодії, невід’ємною умовою якої є залучення міжнародних організацій, що забезпечує ефективність заходів у сфері запобігання домашньому насильству. Розкрито проблемні питання імплементації міжнародних стандартів у національну практику публічного управління в системі протидії та запобігання домашньому. У третьому розділі надано пропозиції щодо удосконалення механізмів забезпечення взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству. З метою ширшого залучення міжнародних організацій до формування та реалізації політики запобігання домашньому насильству, запропоновано створення спеціалізованого органу та колегіального дорадчого органу на рівні центрального органу виконавчої влади. Розроблено комплексну структурно- функціональну модель взаємодії органів публічної влади з міжнародними організаціями, що дає можливість досягти мети управління в даній сфері – забезпечення безпечного сталого розвитку суспільства через ефективне запобігання домашньому насильству. Уперше в галузі знань «Публічне управління та адміністрування» розроблено комплексну структурно-функціональну модель взаємодії органів публічної влади з міжнародними організаціями для забезпечення їх ефективного ефективності залучення на усіх етапах управлінських рішень завдяки комплексному підходу шляхом забезпечення його інституційної, правової, комунікаційної та організаційної складових. У дисертаційній роботі вирішено поставлене завдання у галузі науки публічного управління – вдосконалено теоретичні та методологічні засади механізмів взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству: здійснено аналіз та узагальнено положення нормативно-правової бази України, міжнародного законодавства, напрацювання вітчизняних і зарубіжних науковців у сфері дослідження взаємодії органів публічної влади з міжнародними організаціями щодо запобігання домашньому насильству; запропоновано концептуальний підхід до забезпечення взаємодії, що базується на засадах застосування механізмів забезпечення інституційної спроможності та побудовано модель взаємодії органів публічної влади України з міжнародними організаціями у сфері запобігання домашньому насильству на національному, регіональному та місцевому рівнях; удосконалено систему правових механізмів забезпечення взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству та сформовано практичні рекомендації щодо їх застосування; удосконалено систему механізмів забезпечення інституційної спроможності органів публічної влади у сфері запобігання домашньому насильству; узагальнено теоретичні підходи до визначення понять «домашнього насильства», «запобігання домашньому насильству», «взаємодія органів публічної влади», зосереджено увагу на питаннях неповноти форм домашнього насильства, а також відсутність класифікації суб’єктів запобігання. Визначено особливості інституційного забезпечення взаємодії органів публічної влади з міжнародними організаціями на національному, регіональному та місцевому рівнях. Зосереджено увагу на тому, що базовими принципами взаємодії суб’єктів, уповноважених у сфері запобігання домашньому насильству є: партнерство, що передбачає дієву співпрацю та координацію суб’єктів усіх рівнів; стратегічне планування, що передбачає розробку загальних міжвідомчих стратегій, з подальшим відображенням основних цілей та завдань у програмах запобігання домашньому насильству, з урахуванням особливостей територіальної громади; комплексний підхід та стійкість сталість, що забезпечується через інституційну пам’ять уповноважених суб’єктів. Обгрунтовано теоретичні положення, що розкривають особливості формування механізму взаємодії органів публічної влади з міжнародними організаціями через вдосконалення його інституційних, правових, організаційних та комунікаційних складових та запропоновано модель такої взаємодії. Сформульовано практичні рекомендації органам, уповноваженим на формування та реалізацію державної політики у сфері запобігання та протидії домашньому насильству, щодо вдосконалення інструментів функціонування механізму взаємодії органів публічної влади з міжнародними організаціями у сфері запобігання домашньому насильству. Визначено, що запропоновані заходи сприятимуть розробці і впровадженню дієвих рішень в сфері публічного управління, які спрямовано на запобігання домашньому насильству на місцевому, регіональному та національному рівнях, що забезпечить сталий розвиток суспільства. Здійснено аналіз нормативно-правового забезпечення, ступінь імплементації міжнародного законодавства щодо комплексності запобігання домашньому насильству в контексті виконання євроінтеграційних вимог. Досліджено взаємодію органів публічної влади на національному, регіональному та місцевому рівні. Результати проведеного аналізу засвідчили високий ступінь взаємодії органів публічної влади з міжнародними організаціями на місцевому рівні завдяки інституційному, правовому, організаційному та комунікаційному механізмам. Встановлено залежність ефективності взаємодії органів публічної влади від представництва суб’єктів, уповноважених на запобігання та протидію домашньому насильству у складі координаційного органу, в тому числі міжнародних організацій. В результаті проведеного аналізу виявлено неефективність взаємодії органів публічної влади з міжнародними організаціями на національному рівні через відсутність окремої інституції щодо запобігання та протидії домашньому насильству та постійно діючого колегіального дорадчого органу. Запропоновано створення інституції на національному рівні та Міжнародної консультативної ради при Міністерстві соціальної політики для налагодження, розвитку та підтримання відносин між національними та іноземними органами та установами системи запобігання та протидії домашньому насильству, а також міжнародними організаціями, обмін досвідом, консультативною, експертною, іншою допомогою. Дослідженням встановлено відсутність комплексного стратегічного документа, який би визначав пріоритетні напрями консолідованих дій центральних та місцевих органів публічної влади, інститутів громадянського суспільства, суб’єктів господарювання для запобігання домашньому насильству. Узагальнено досвід формування та реалізації політики запобігання домашньому насильству в країнах Європейського Союзу з метою імплементації кращих практик в Україні, а саме: приведення законодавчої бази до вимог міжнародних стандартів та реалій сьогодення; створення спеціального органу у сфері запобігання домашньому насильству; запровадження стратегічного планування діяльності усіх суб’єктів, уповноважених на запобігання домашньому насильству, та дорадчих органів на національному, регіональному та місцевому рівнях; забезпечення єдності збору даних щодо запобігання домашньому насильству; підвищення відповідальності уповноважених суб’єктів у сфері запобігання домашньому насильству; запровадження сталого співробітництва з міжнародними організаціями. Досліджено, що в країнах Європейського Союзу належний рівень взаємодії з міжнародними організаціями у сфері запобігання домашньому насильству забезпечив ефективність імплементації Конвенції Ради Європи про запобігання насильству щодо жінок та домашньому насильству, що має виняткове значення для України, яка ратифікувала Конвенцію у 2022 році. Встановлено, що в Україні відсутні чіткі, вичерпні та систематичні дані щодо всіх форм домашнього насильства, що негативно впливає на ухвалення обґрунтованих рішень. Запропоновано створення єдиної платформи обліку даних та їх моніторингу щодо запобігання та протидії домашньому насильству. Розроблено модель взаємодії органів публічної влади України з міжнародними організаціями у сфері запобігання домашньому насильству. Обґрунтовано необхідність використання комунікаційного механізму в системі взаємодії суб’єктів, уповноважених на запобігання та протидію домашньому насильству, з міжнародними організаціями для забезпечення ефективного зворотнього зв’язку з метою оперативного реагування на виклики в умовах воєнного стану.The dissertation proposes a solution to the current scientific task in the field of science "Public management and administration", which consists in the theoretical and scientific-practical substantiation of the priority areas of interaction of public authorities with international organizations in the field of domestic violence prevention and the development of practical recommendations for their improvement. The first chapter of the dissertation is devoted to the theoretical and methodological foundations of preventing domestic violence. Attention is focused on the development of the institutional capacity of entities authorized to prevent and combat domestic violence at the national, regional, and local levels. Based on the analysis of scientific sources, the issue of the essence of domestic violence and prevention was revealed, the classification of authorized subjects in the field of prevention was supplemented, and an analysis of institutional support in the field of domestic violence prevention in Ukraine was carried out. The second chapter analyzes the regulatory and legal provision of interaction between public authorities and international organizations in the field of domestic violence prevention. An analysis of the situation was carried out and problematic issues of the interaction of public authorities with international organizations at the national, regional and local levels were identified, ways of solving them were proposed, through the development and implementation of a state strategy of interaction, an integral condition of which is the involvement of international organizations, which ensures the effectiveness of measures in the field of domestic violence prevention. Problematic issues of the implementation of international standards into the national practice of public administration in the system of countermeasures and prevention of domestic violence are revealed. In the third section, proposals are given for improving the mechanisms for ensuring the interaction of public authorities with international organizations in the field of domestic violence prevention. With the aim of wider involvement of international organizations in the formation and implementation of the domestic violence prevention policy, the creation of a specialized body and a collegial advisory body at the level of the central executive body was proposed. A complex structural and functional model of interaction between public authorities and international organizations has been developed, which makes it possible to achieve the goal of management in this area - ensuring the safe and sustainable development of society through the effective prevention of domestic violence. For the first time in the field of knowledge "Public management and administration" a complex structural and functional model of interaction of public authorities with international organizations has been developed to ensure their effective efficiency of involvement at all stages of management decisions thanks to a comprehensive approach by ensuring its institutional, legal, communication and organizational components. In the dissertation work, the task set in the field of public administration science was solved - the theoretical and methodological foundations of the mechanisms of interaction of public authorities with international organizations in the field of domestic violence prevention were improved: the analysis was carried out and the provisions of the regulatory and legal framework of Ukraine, international legislation, the development of domestic and foreign scientists in the field of research on the interaction of public authorities with international organizations regarding the prevention of domestic violence; a conceptual approach to ensuring cooperation is proposed, based on the principles of applying mechanisms for ensuring institutional capacity, and a model of cooperation between public authorities of Ukraine and international organizations in the field of domestic violence prevention at the national, regional and local levels is built; the system of legal mechanisms for ensuring the interaction of public authorities with international organizations in the field of domestic violence prevention has been improved and practical recommendations for their application have been formed; the system of mechanisms for ensuring the institutional capacity of public authorities in the field of domestic violence prevention has been improved; the theoretical approaches to defining the concepts of "domestic violence", "prevention of domestic violence", "interaction of public authorities" are summarized, attention is focused on the issues of incomplete forms of domestic violence, as well as the lack of classification of prevention subjects. The features of the institutional support for the interaction of public authorities with international organizations at the national, regional and local levels have been determined. Attention is focused on the fact that the basic principles of interaction of subjects authorized in the field of domestic violence prevention are: partnership, which involves effective cooperation and coordination of subjects of all levels; strategic planning, which involves the development of common interdepartmental strategies, followed by the reflection of the main goals and objectives in domestic violence prevention programs, taking into account the characteristics of the territorial community; integrated approach and sustainability sustainability, which is ensured through the institutional memory of authorized subjects. The theoretical provisions that reveal the peculiarities of the formation of the mechanism of interaction between public authorities and international organizations through the improvement of its institutional, legal, organizational and communication components are substantiated, and a model of such interaction is proposed. Practical recommendations have been formulated for bodies authorized to form and implement state policy in the field of prevention and combating domestic violence, regarding the improvement of tools for the functioning of the mechanism of interaction between public authorities and international organizations in the field of domestic violence prevention. It was determined that the proposed measures will contribute to the development and implementation of effective solutions in the field of public administration, which are aimed at preventing domestic violence at the local, regional and national levels, which will ensure the sustainable development of society. The analysis of regulatory and legal support, the degree of implementation of international legislation regarding the complexity of domestic violence prevention in the context of the fulfillment of European integration requirements was carried out. The interaction of public authorities at the national, regional and local levels was studied. The results of the analysis showed a high degree of interaction between public authorities and international organizations at the local level thanks to institutional, legal, organizational and communication mechanisms. It was established that the effectiveness of the interaction of public authorities depends on the representation of subjects authorized to prevent and combat domestic violence as part of the coordination body, including international organizations. As a result of the analysis, the inefficiency of the interaction of public authorities with international organizations at the national level was revealed due to the absence of a separate institution for the prevention and counteraction of domestic violence and a permanent collegial advisory body. It is proposed to create an institution at the national level and an International Advisory Council under the Ministry of Social Policy to establish, develop and maintain relations between national and foreign bodies and institutions of the system of preventing and countering domestic violence, as well as international organizations, exchange of experience, advisory, expert and other assistance. The research established the absence of a comprehensive strategic document that would determine the priority directions of consolidated actions of central and local public authorities, civil society institutions, and business entities to prevent domestic violence. The experience of forming and implementing the domestic violence prevention policy in the countries of the European Union is summarized with the aim of implementing best practices in Ukraine, namely: bringing the legislative framework to the requirements of international standards and today's realities; creation of a special body in the field of domestic violence prevention; introduction of strategic planning of activities of all subjects authorized to prevent domestic violence and advisory bodies at the national, regional and local levels; ensuring the unity of data collection on the prevention of domestic violence; increasing the responsibility of authorized subjects in the field of domestic violence prevention; introduction of sustainable cooperation with international organizations. It was investigated that in the countries of the European Union, the appropriate level of interaction with international organizations in the field of domestic violence prevention ensured the effectiveness of the implementation of the Council of Europe Convention on the Prevention of Violence against Women and Domestic Violence, which is of exceptional importance for Ukraine, which ratified the Convention in 2022. It has been established that there is a lack of clear, comprehensive and systematic data on all forms of domestic violence in Ukraine, which negatively affects the adoption of informed decisions. It is proposed to create a single platform for recording and monitoring data on preventing and combating domestic violence. A model of interaction between public authorities of Ukraine and international organizations in the field of domestic violence prevention has been developed.
