Вісник кримінального судочинства(1).https://ir.library.knu.ua/handle/15071834/23637This scientific opinion examines the constitutionality of part 1 of Article 459 of the Criminal Procedure Code of Ukraine, which governs proceedings on newly discovered circumstances to review investigative judges’ decisions. Although no explicit prohibition exists, the provision’s legal uncertainty and lack of procedural mechanism effectively deprive individuals of their constitutionally guaranteed right to judicial protection and access to appellate and cassation review. This contravenes the principles of the rule of law (Art. 8 of the Constitution) and the right to challenge judicial decisions (Art. 55 of the Constitution). It is recommended to amend the CPC to explicitly ensure the review of investigative judges’ rulings on newly discovered facts.У науковому висновку проаналізовано конституційність положень частини першої статті 459 КПК України, яка регулює провадження за нововиявленими обставинами щодо перегляду ухвал слідчого судді. Встановлено, що, хоча пряма заборона на такий перегляд у цій нормі відсутня, на практиці через невизначеність термінології та відсутність процесуального механізму особа позбавляється гарантованого конституцією права на судовий захист та доступ до апеляційного й касаційного перегляду. Це суперечить принципам верховенства права (ст. 8 Конст. України) та права на оскарження судових рішень (ст. 55 Конст. України). Рекомендовано чітко закріпити в КПК можливість оскарження ухвал слідчого судді за нововиявленими обставинами.ukСтаття
