Соціальне право(2), 14–19.https://ir.library.knu.ua/handle/15071834/24404In this scientific and theoretical article, the peculiarities of the resolution of individual labor disputes in the labor disputes commission through the prism of the new codification of labor legislation are explored. It is noted that such commissions solve individual labor disputes (conflicts) between the employee and the employer arising from the content of the employment contract. The problematic aspects of the work of the commissions, especially the current Code of Labor Laws of Ukraine, are noted. The negative tendencies of application of the Soviet labor legislation to the present state of the settlement of labor disputes in the commission on labor disputes, their labor-legal status are noted. The importance of new approaches to labor-legal status of commissions on labor disputes in the process of codification of labor legislation is indicated. The peculiarities of the labor-legal status of these bodies are considered in the contents of the draft Labor Code. Conclusions and suggestions are made.У цій науково-теоретичній статті досліджуються особливості вирішення індивідуальних трудових спорів у комісії по трудових спорах через призму новітньої кодифікації трудового законодавства. Наголошено на тому, що такі комісії вирішують індивідуальні трудові спори (конфлікти) між працівником та роботодавцем, які випливають із змісту трудового договору. Відзначено проблемні аспекти діяльності комісій, особливо за чинним Кодексом законів про працю України. Відзначено негативні тенденції застосування радянського трудового законодавства до сучасного стану врегулювання трудових спорів у комісії по трудових спорах, їх трудо-правового статусу. Вказано на важливість нових підходів до трудо-правового статусу комісій по трудових спорах у процесі кодифікації трудового законодавства.
