Концепція смарт-міста лише починає формуватися і це стосується як України, так і світу загалом. Триває робота з розроблення її основних визначень і положень, досі немає чіткого та послідовного її розуміння, як серед практиків, так і в наукових колах. Дана концепція використовується у різних номенклатурних значеннях і сенсах і не лише в науковій літературі, а й в інших контекстах. Наявність великої кількості визначень смарт-міста потребує проведення концептуальних досліджень у цій сфері. Наукова новизна отриманих результатів полягає в тому, що в результаті комплексного дослідження отримано нові наукові результати щодо обґрунтування механізмів формування цифрової інфраструктури смарт-міст в Україні, їх інституціоналізації в системі публічного управління та адміністрування та вироблені практичних рекомендацій щодо удосконалення нормативно-правової бази для впровадження цифрових технологій у смарт-міста. Дисертанткою уперше сформовано концептуальну модель побудови цифрової-інфраструктури сучасних смарт-міст в Україні, де на основі основних рівнів управління – глобального, макр-, мезо-, мікрорівня та особистісного рівня розроблено механізми, які повинні бути реалізовані за для створення цифрової інфраструктури при узгодженні інтересів усіх членів суспільства та на всіх рівнях управління, оскільки взаємодія між даними учасниками і рівнями має бути взаємоузгодженою, керованою, оснащеною інтегрованими інструментами і зручностями інформаційного характеру. Дисертанкою удосконалено напрямки організаційно-правових механізмів впровадження цифрової інфраструктури смарт-міст в Україні, зокрема такі напрямки як: напрямок стратегічного планування, напрямок фінансового забезпечення, напрямок стимулювання інвестицій, напрямок технологічних унормувань, напрямок з координації та обміном досвідом і напрямок мережевого співробітництва; інструменти державної політики модернізації цифрової інфраструктури смарт-міст України, зокрема обґрунтовано впровадження цифрових інструментів в транспортній інфраструктурі, енергетичному секторі, фінансовому та інвестиційному секторі тощо. Розглядаючи питання вдосконалення інструментів державної політки модернізації цифрової інфраструктури смарт-міст України необхідно забезпечення дієвої та ефективної нормативно-правової бази, що дозволить реалізувати основні засади даної політики. Набули подальшого розвитку понятійно-категоріальний апарат дослідження концепції смарт-міста, зокрема на основі проведеного дослідження основних підходів до поняття смарт-місто, було запропоновано власне визначення поняття «смарт-місто», яке являє собою комплексну та багатофакторну муніципальну систему, яка об’єднана навколо системи спеціалізованих інституцій, що інтегровані в міський простір та направлена на підвищення рівня життя мешканців і забезпечення їх комфорту, шляхом взаємодії органів управління та громадян, через використання новітніх інформаційно-комунікаційних та технічних наукових досягнень. Разом з тим, поняття «смарт-місто» постійно модернізується, набуває все нових ознак в епоху стрімкого розвитку технологій, що додають йому все більш нових та поглиблених характеристик; Також, досліджено фактори, що впливають на розвиток процесів розбудови смарт-міст на основі здійсненого SWOT-аналізу розвитку концепції смарт міст в Україні, зокрема визначено, що до позитивних внутрішніх сильних сторін розвитку концепції смарт-міст в Україні може бути віднесена велика кількість креативних і талановитих молодих людей у галузі ІТ, висока комп’ютерна грамотність населення, наявність матеріально-технічної інфраструктури на всіх рівнях. При цьому, до можливостей для розвитку концепції смарт-міст в Україні можна віднести активний розвиток стартапів та підприємництва, впровадження новітніх засобів ведення бізнесу, розвиток та заохочення моделі управління, орієнтованої на людину. До слабких сторін внутрішнього характеру в Україні можна зазначити відсутність єдиного підходу на державному та місцевому рівнях щодо розробки та впровадження концепції смарт-міст; брак інформаційно-комунікаційної інфраструктури, систем безпеки, методів ідентифікації тощо; недостатня кількість спеціалістів, що відповідають даному управлінському рівню. Також, до зовнішніх загроз відносять розрізненість національної цифрової моделі через створення окремих центрів даних, ідентифікаційних систем, індивідуальних стратегій в містах; підміна понять простої автоматизації процесів реальною смартизацією міст; питання інформаційної безпеки та захисту приватної інформації. Розроблено пропозиції, щодо вдосконалення напрямків організаційно-правових механізмів впровадження цифрової інфраструктури смарт-міст в Україні, зокрема по напрямку стратегічне планування пропонується реалізувати заходи з розробки і затвердження національної стратегії розвитку смарт-міст, де визначено цілі, пріоритети, етапи, джерела фінансування проектів смарт-міст, а також механізми державної підтримки міст у реалізації концепцій смарт-міста; напрям фінансового забезпечення передбачає створення цільового фонду фінансування проектів смарт-міст, який акумулюватиме як бюджетні кошти, так і залучені ресурси (гранти, інвестиції, кредити міжнародних організацій); в напрямку стимулювання інвестицій пропонується упровадження спеціальних правових механізмів стимулювання залучення приватних інвестицій в проекти смарт-міста через державно-приватне партнерство. Це можуть бути податкові пільги, пільгове кредитування, гарантії держави за інвестиційними ризиками тощо; щодо технологічних унормувань, то тут пропонується удосконалення регулювання цифрових технологій для інфраструктури смарт-міст. Це стосується регулювання Big Data, штучного інтелекту, кібербезпеки, електронних сервісів та платформ смарт-міст; напрям з координації та обміном досвідом необхідний для координації проєктів смарт-міст між органами місцевого самоврядування. Створення всеукраїнської асоціації смарт-міст; напрямок мережевого співробітництва передбачає залучення передових організаційних форм зарубіжного досвіду у реалізації концепцій смарт-міст в Україні. Робота має практичне значення, оскільки її основні теоретичні положення, отримані наукові результати і висновки, практично орієнтовані рекомендації дисертаційного дослідження можуть сприяти вдосконаленню організаційно-правових засад формування цифрової інфраструктури смарт-міст в Україні. Розроблені наукові положення та практичні й теоретичні рекомендації можуть бути використані в діяльності органів державної влади, зокрема при розробці національної стратегії розвиту смарт-міст, а також при вдосконаленні нормативно-правової бази для впровадження цифрових технологій у смарт-міста. Результати наукового дослідження використано у практичній діяльності органів державної влади, зокрема Державно інспекцією архітектруи та містобудування України у процесі підготовки прппозицій щодо підзаконних нормативно-правоввих актів, що стосуються реалізації концепції смарт-міст.The dissertation study is devoted to the study of the mechanisms of formation of the digital infrastructure of smart cities in Ukraine. The concept of a smart city is just being formed, both in Ukraine and in the world. Work is ongoing to develop its basic definitions, there is still no clear and consistent understanding of it among practitioners and in academic circles. This concept is used in different senses and nomenclature meanings not only in scientific literature, but also in other contexts. The presence of a variety of smart city definitions requires conceptual research in this area. The scientific novelty of the obtained results lies in the fact that as a result of a complex study, new scientific results were obtained regarding the substantiation of the mechanisms for the formation of the digital infrastructure of smart cities in Ukraine, their institutionalization in the system of public management and administration, and practical recommendations were made for the improvement of the regulatory and legal framework for the implementation of digital technologies in smart cities. For the first time, the doctoral student created a conceptual model for building the digital infrastructure of modern smart cities in Ukraine, where, based on the main levels of management - global, macro-, meso-, micro-, and personal levels, mechanisms were developed that should be implemented in order to create a digital infrastructure with the coordination of interests of all members of society and at all levels of management, since the interaction between these participants and levels must be coordinated, managed, equipped with integrated tools and facilities of an informational nature. The dissertation improved the directions of the organizational and legal mechanisms for the implementation of the digital infrastructure of smart cities in Ukraine, in particular such directions as: the direction of strategic planning, the direction of financial support, the direction of investment stimulation, the direction of technological standardization, the direction of coordination and exchange of experience, and the direction of network cooperation; tools of the state policy of modernization of the digital infrastructure of smart cities of Ukraine, in particular, the implementation of digital tools in the transport infrastructure, energy sector, financial and investment sector, etc. is substantiated. When considering the issue of improving the instruments of the state policy of modernization of the digital infrastructure of smart cities of Ukraine, it is necessary to ensure an effective and efficient legal framework that will allow the implementation of the main principles of this policy. The conceptual and categorical apparatus of the study of the concept of a smart city has developed further, in particular, on the basis of the conducted study of the main approaches to the concept of a smart city, a proper definition of the concept of a "smart city" has been proposed, which is a complex and multifactorial municipal system that is united around a system of specialized institutions integrated into the urban space and aimed at raising the standard of living of residents and ensuring their comfort, through the interaction of management bodies and citizens, through the use of the latest information, communication and technical scientific achievements. At the same time, the concept of "smart city" is constantly being modernized, acquiring more and more new features in the era of rapid development of technologies, which add more and more new and advanced characteristics to it; Also, the factors affecting the development of smart city development processes were investigated on the basis of the SWOT analysis of the development of the concept of smart cities in Ukraine. talented young people in the field of IT, high computer literacy of the population, availability of material and technical infrastructure at all levels. At the same time, opportunities for the development of the concept of smart cities in Ukraine include the active development of startups and entrepreneurship, the introduction of the latest means of doing business, the development and promotion of a human-oriented management model. Weaknesses of an internal nature in Ukraine include the lack of a unified approach at the state and local levels regarding the development and implementation of the concept of smart cities; lack of information and communication infrastructure, security systems, identification methods, etc.; insufficient number of qualified specialists at the managerial level. Also, external threats include the disparity of the national digital model due to the establishment of separate data centers, identification systems, individual strategies in cities; replacing the concepts of simple automation of processes with real smartization of cities; issues of information security and protection of private information. Proposals have been developed to improve the areas of organizational and legal mechanisms for the implementation of the digital infrastructure of smart cities in Ukraine, in particular, in the direction of strategic planning, it is proposed to implement measures for the development and approval of the national strategy for the development of smart cities, where the goals, priorities, stages, sources of funding for smart cities are defined - the city, as well as mechanisms of state support for cities in the implementation of smart city concepts; the direction of financial support involves the creation of a target fund for financing smart city projects, which will accumulate both budget funds and resources (grants, investments, loans from international organizations); in the direction of stimulating investments, it is proposed to introduce special legal mechanisms for stimulating the attraction of private investments in smart city projects through public-private partnerships. These can be tax benefits, preferential lending, state guarantees for investment risks, etc.; regarding technological regulations, it is proposed to improve the regulation of digital technologies for the infrastructure of smart cities. This concerns the regulation of Big Data, artificial intelligence, cyber security, electronic services and smart city platforms; the direction of coordination and exchange of experience is necessary for the coordination of smart city projects between local self-government bodies. Creation of the All-Ukrainian Association of Smart Cities; the direction of network cooperation involves the involvement of advanced organizational forms of foreign experience in the implementation of smart city concepts in Ukraine. The work has practical significance, as its main theoretical provisions, obtained scientific results and conclusions, practically oriented recommendations of the dissertation research can contribute to the improvement of the organizational and legal foundations of the formation of the digital infrastructure of smart cities in Ukraine. The developed scientific provisions and practical and theoretical recommendations can be used in the activities of state authorities, in particular, in the development of a national strategy for the development of smart cities, as well as in the improvement of the legal framework for the introduction of digital technologies in smart cities.
