It is established that general legal principles should be considered basic legal ideas that extend their effect to the entire legal system, not just to a separate branch of law. However, within each specific branch of law, these principles acquire special characteristics. The special characteristics of the general legal principles of labor law in Ukraine indicate the possibility of considering these fundamental ideas as the ideological foundations of the legal regime for preventing and combating corruption in Ukraine. Such principles typically include the rule of law, legality, human-centrism, equality, justice, and others. Within the framework of this scientific article, special attention is paid to the principles of the rule of law, human-centrism, and legal legitimacy. As the fundamental ideological basis for preventing and combating corruption, the principle of the rule of law requires the following: firstly, it necessitates ensuring legal certainty in the emergence, course, suspension, termination, and restoration of labor relations, as well as the legal status of subjects of labor law. Secondly, it requires the state to provide effective and accessible legal mechanisms for protecting the labor rights of citizens from arbitrary or illegal actions by other individuals or legal entities, as well as by the state and civil society entities. Thirdly, it demands the inviolability of the law. Fourthly, it requires a state in which the law is comprehensively protected, particularly by ensuring both positive and negative legal liability within the scope of labor law. The principle of legality (or legal legitimacy), as a fundamental basis for preventing and combating corruption, requires the following: firstly, it necessitates a state in which the main legislative acts in the field of labor and employment unconditionally comply with the principles and norms of law, and other legislative acts, by-laws, and contracts (agreements) align with the norms of the main legislative acts in the field of labor and employment. Secondly, it requires clarity and predictability in the norms of the current legislation. Thirdly, it demands the creation and effective operation of mechanisms for controlling and supervising the implementation of legal norms in the field of labor and employment. Fourthly, it ensures conditions in the field of labor and employment where all subjects of labor law are considered equal before the law. As a fundamental basis for preventing and combating corruption, the principle of human-centrism requires the following: firstly, it necessitates the recognition and protection of human rights, as well as respect for human dignity. Secondly, it requires ensuring transparency and openness in employment processes and other personnel procedures, particularly those where corruption may manifest. Thirdly, it demands the assurance of social security for workers. The conclusions summarize the results of this scientific explorationСтаття присвячена з’ясуванню загальноправових принципів трудового права України, як засадничих основ запобігання і протидії корупції. Встановлюється, що загальноправові принципи ті засадничі ідеї, які поширюють свою дію на всю систему права, а не лише на окрему галузь права, однак в рамках кожної конкретної галузі права набувають спеціальних характеристик. Спеціальні характеристики загальноправових принципів трудового права України засвідчують можливість розгляду цих засадничих ідей в якості ідейних основ правового режиму запобігання і протидії корупції в Україні. До таких принципів загалом прийнято відносити принципи верховенства права, законності, людиноцентризму, рівності, справедливості та ін. У рамках статті особлива увага приділяється саме принципам верховенства права, людиноцентризму та правової законності. Як засаднича основа запобігання і протидії корупції принцип верховенства права: по-перше, вимагає забезпечення правової визначеності виникнення, перебігу, призупинення, припинення, і навіть відновлення трудових відносин, і навіть правових статусів суб’єктів трудового права; по-друге, вимагає існування та забезпечення державою ефективних та доступних юридичних механізмів для захисту трудових прав громадян від довільних чи незаконних дій з боку інших фізичних чи юридичних осіб, а також з боку держави та суб’єктів громадянського суспільства; по-третє, вимагає недоторканності права; по-четверте, вимагає стану, за якого право комплексно захищається державою, зокрема, шляхом забезпечення позитивної та негативної юридичної відповідальності у сфері дії трудового права. Принцип правової законності, як засаднича основа запобігання і протидії корупції: по-перше, вимагає стану, за якого наявна безумовна відповідність основних законодавчих актів у сфері праці та зайнятості принципам та нормам права, а інших законодавчих, підзаконних актів та договорів (угод) – нормам основних законодавчих актів у сфері праці та зайнятості; по-друге, вимагає чіткості та передбачуваності норм чинного законодавства; по-третє, вимагає створення та забезпечення ефективної дії механізмів контролю та нагляду за виконанням правових норм у сфері праці та зайнятості; по-четверте, вимагає забезпечення у сфері праці та зайнятості умов, за яких усі суб’єкти трудового права будуть вважатися рівними передзаконом. Як засаднича основа запобігання і протидії корупції принцип людиноцентризму: по-перше, вимагає визнання та захисту прав людини, а також поваги людської гідності; по-друге, вимагає забезпечення прозорості та відкритості процесів працевлаштування та інших кадрових процедур, а насамперед – тих, у яких може виявлятися корупція; по-третє, вимагає забезпечення соціальної безпеки працівників.
