Соціальне право(2), 127–133.https://ir.library.knu.ua/handle/15071834/24424The article gives a true understanding of the terminological notion of "the principles of functioning of the civil service", and it is emphasized that their consolidation is carried out in the Constitution of Ukraine, the Law of Ukraine "On Civil Service", and other subordinate legal acts related to the functioning and functioning of the civil service in Ukraine. The consolidation of the principles of civil service in the current Law of Ukraine "On Civil Service" and the Law of Ukraine "On Civil Service" of 1993 are described, and the shortcomings of the new law concerning the absence of consolidation of such principles as: democracy, humanism, social justice, initiative, competence, loyalty are pointed out. in fact, observance of the rights and legitimate interests of local self-government bodies and observance of the rights of enterprises, institutions and organizations, associations of citizens. Within the framework of the article, the principles of functioning of the civil service are divided by the scientist according to their orientation into groups, as well as their consideration.У статті надано власне розуміння термінологічного поняття «принципи функціонування державної служби», наголошено та тому, що їх закріплення здійснюється в Конституції України, Законі України «Про державну службу» інших підзаконних нормативно-правових актах, які стосуються діяльності та функціонування державної служби в Україні. Охарактеризовано закріплення принципів державної служби в чинному Законі України «Про державну службу» та Законі України «Про державну службу» від 1993 року, вказано на недоліки нового закону щодо відсутності закріплення таких принципів як: демократизм, гуманізм, соціальна справедливість, ініціативність, компетентність, відданість справі, дотримання прав і законних інтересів органів місцевого самоврядування й дотримання прав підприємств, установ та організацій, об’єднань громадян.
