Додатково виокремлюється специфіка правовідносин у сфері капітального будівництва і ризики, що виникають при здійсненні такої діяльності. Проведено аналіз відмінності теоретичних і практичних підходів до страхування ризиків при здійсненні капітального будівництва.The article investigates insurance legal relations in the process of capital construction by applying the three-level concept of research, which consists of a general theoretical, field-theoretical and concrete theoretical levels. It is proved that insurance relationship in capital construction business is a type of insurance relationship, which in turn is a kind of economic relations, and as a consequence, the subject of research on the science of economic law. The features of insurance legal relations in the implementation of capital construction is disclosed through a number of features that are inherent in them, namely: risky nature; presence of insurance interest; one of the parties is an insurance organization; formed a special insurance fund, an insurance reserve; legal relations arise from direct orders of the law and the foreseen legal facts; complex property-organizational legal relations; the content is the organization, manufacture and delivery by the contracting organization of the designated (ordered) customer of design and survey and / or construction and related work, acceptance and payment by the customer, commissioning of the completed construction of the facility; the occurrence between the customer and the investor; when transferring the real estate object to the operating organization; attraction of financing to capital construction. In addition, the specifics of legal relations in the field of capital construction and the risks that disappear in such business. The analysis of excellent theoretical and practical approaches to insuring risks when capital construction is carried out.
