Структурно­логічна схема дисертаційної роботи побудована на основі таких науково­дослідницьких блоків: аналіз теоретико­методичних основ формування механізмів державного регулювання ринку азартних ігор і лотерей; діагностика особливостей формування та реалізації механізмів державного регулювання ринку азартних ігор і лотерей в Україні; обґрунтування напрямів удосконалення механізмів державного регулювання ринку азартних ігор і лотерей в Україні. Актуальність теми дисертаційного дослідження полягає в тому, що господарська діяльність на ринку азартних ігор і лотерей є одним зі специфічних видів економічної діяльності, яка займає окреме місце в структурі економіки. Зазначене обумовлено певною специфікою азартної гри як складного суспільного явища, що потребує вироблення особливих підходів до її регулювання з боку держави та завжди супроводжується прискіпливою увагою суспільства. У зв’язку з цим питання азартних ігор і лотерей у контексті соціально­економічної компоненти сталого розвитку України та з урахуванням обраного курсу на демократичний розвиток, створення держави для людей, інтеграції до європейської спільноти, а також прагнення до перетворення на конкурентоспроможну державу вимагають від останньої відповідності сучасним технологічним та глобалізаційним викликам, а так само створення на рівні державної політики у сфері азартних ігор і лотерей адекватних умов як для бізнесу, так і для населення країни. Тобто державна політика щодо ринку азартних ігор і лотерей в Україні має бути реакцією державного апарату на конкретні проблеми суспільства задля узгодження інтересів всіх стейкхолдерів шляхом винайдення необхідного для стабільності суспільства оптимального консенсусу. В Україні діяльність у сфері організації та проведення азартних ігор і лотерей протягом тривалого часу не мала ефективного державного регулювання. Так, наприклад, азартні ігри до липня 2020 року взагалі перебували поза межами правового врегулювання, а лотерейна діяльність у нашій країні й наразі здійснюється за відсутності дієвого державного контролю. Зазначені обставини не сприяють природньому розвитку суспільних процесів на ринку азартних ігор і лотерей, що насамперед обумовлює об’єктивну доцільність наукового пошуку нових підходів до державного регулювання суспільних відносин у цій сфері. Отже, сукупність вищезазначених чинників актуалізує науково­ практичну значимість проведення комплексного наукового дослідження механізмів державного регулювання ринку азартних ігор та лотерей в Україні. Метою дисертаційної роботи є теоретико­методичне обґрунтування механізмів державного регулювання ринку азартних ігор і лотерей та розробка рекомендацій щодо їх удосконалення та практичного впровадження в Україні. Об’єкт дослідження – суспільні відносини, що виникають у процесі державного регулювання ринку азартних ігор і лотерей. Предмет дослідження – механізми державного регулювання ринку азартних ігор і лотерей в Україні. Для досягнення мети й виконання поставлених завдань у дисертації використано комплекс загальнонаукових і спеціальних методів та підходів, серед них: семантико­етимологічний; історичний; загальнонаукового аналізу; систематизації та узагальнення, системного аналізу; структурно­ функціональний; статистичний, графічний, табличний, середніх та відносних величин; моделювання й абстрагування; діалектичний, синтез та індукція тощо. У дисертаційній роботі вперше розроблено й обґрунтовано комплексний механізм державного регулювання ринку азартних ігор і лотерей в Україні, який представлено як упорядковану управлінську конструкцію вертикально та горизонтально взаємопов’язаних і взаємоузгоджених способів впливу на об’єкт регулювання, сформованих відповідно до мети, завдань, принципів і функцій державного регулювання, аксіологічно пов’язаних із позиціонуванням перспективного стану національного ринку азартних ігор і лотерей. Така конструкція передбачає інтегративну взаємодію різних механізмів державного регулювання (організаційно­правового, фінансово­ економічного та соціально­інформаційного), призначених задля створення належних передумов для досягнення мети державного регулювання ринку азартних ігор і лотерей в Україні з урахуванням публічного запиту суспільства, а також трансформаційного євроінтеграційного вектору розвитку суспільно­політичних процесів у країні. У роботі вдосконалено теоретичні засади організації діяльності на ринку азартних ігор і лотерей, що передбачають віднесення такого ринку до господарської діяльності у сфері послуг, де ринок азартних ігор за формою є ринком особливої товарної групи – азартні ігри (включаючи лотерею), за видом належить до ринку товарів і послуг як споживчий ринок, параметри (попит, пропозиція, ціна, кон’юнктура, рівновага) і атрибути якого (конкуренція, монополія, олігополія) формуються з урахуванням впливу держави через застосування відповідних механізмів державного регулювання. У результаті проведених досліджень також було вдосконалено теоретичні засади політики державного регулювання ринку азартних ігор і лотерей у контексті: а) обґрунтування складу та структури ринку азартних ігор і лотерей шляхом ідентифікації його складових елементів та систематизації їх основних характеристик; б) уточнення видів суспільних взаємовідносин на ринку азартних ігор і лотерей; в) ідентифікації складу та змісту механізмів державного регулювання ринку азартних ігор і лотерей, а саме: організаційно­правового, фінансово­ економічного та соціально­інформаційного. Водночас у дисертаційній роботі набули подальшого розвитку: − понятійно­категорійний апарат у галузі публічного управління та адміністрування, завдяки уточненню сутності таких понять як “державне регулювання ринку азартних ігор і лотерей” − вплив держави на суспільні процеси на ринку азартних ігор і лотерей та поведінку його учасників з метою формування правового та соціального середовища, що сприяє збалансуванню економічних та соціальних інтересів усіх стейкхолдерів у цій сфері, а також виробленню консенсусу щодо сталого розвитку суспільства; “механізми державного регулювання ринку азартних ігор і лотерей” – комплекс взаємопов’язаних та взаємоузгоджених цілеспрямованих способів впливу держави (методів, інструментів, засобів, важелів, форм, напрямів тощо) на суспільні процеси на ринку азартних ігор і лотерей загалом та поведінку його учасників, зокрема з метою формування правового та соціального середовища, що сприяє збалансуванню економічних та соціальних інтересів усіх стейкхолдерів у цій сфері, а також виробленню консенсусу щодо сталого розвитку суспільства; − перспективні напрями вдосконалення механізмів державного регулювання ринку азартних ігор і лотерей в Україні та інструменти їх реалізації, що враховують національні інтереси (в контексті сучасних суспільних викликів та загроз), а також можливості імплементації прогресивного зарубіжного досвіду в цій сфері. Практичне значення одержаних результатів полягає в тому, що основні теоретичні положення та висновки дисертації доведено до рівня конкретних пропозицій, що сприятимуть удосконаленню механізмів державного регулювання ринку азартних ігор і лотерей в Україні з урахуванням її національних інтересів та євроінтеграційних перспектив розвитку.In the dissertation, a theoretical and methodological substantiation of the mechanisms of state regulation of the gambling and lottery market was carried out, and recommendations were developed for their improvement and practical implementation in Ukraine The structural and logical scheme of the dissertation is built on the basis of the following scientific and research blocks: analysis of the theoretical foundations of the formation of mechanisms of state regulation of the gambling and lottery market; diagnosis of peculiarities of the formation and implementation of mechanisms of state regulation of the gambling and lotteries market in Ukraine; substantiation of directions for improving mechanisms of state regulation of the gambling and lotteries market in Ukraine. The relevance of the topic of the dissertation research lies in the fact that economic activity in the market of gambling and lotteries is one of the specific types of economic activity that occupies a separate place in the structure of the economy. This is due to a certain specificity of gambling as a complex social phenomenon, which requires the development of special approaches to its regulation by the state and is always accompanied by meticulous attention of society. In this regard, the issue of gambling and lotteries in the context of the socio­economic component of sustainable development of Ukraine and taking into account the chosen course of democratic development, creation of a state for people, integration into the international community, as well as the desire to transform into a competitive state require the latter compliance with modern technological and globalization challenges, as well as the creation at the level of state policy in the field of gambling and lotteries of adequate conditions for both business and the country's population. That is, the state policy regarding the gambling and lottery market should be the reaction of the state apparatus to the specific problems of society in order to harmonize the interests of all stakeholders by finding the optimal consensus necessary for the stability of society. In Ukraine, activities in the field of organizing and conducting gambling and lotteries have not had effective state regulation for a long time. So, for example, until July 2020, gambling was generally outside the boundaries of legal regulation, and lottery activities in our country are still carried out in the absence of effective state control. The specified circumstances do not contribute to the natural development of social processes in the market of gambling and lotteries, which, in turn, conditions the objective expediency of the scientific search for new approaches to state regulation of social relations in this area. Therefore, the combination of the above­mentioned factors actualizes the scientific and practical significance of conducting a comprehensive scientific study of the mechanisms of state regulation of the gambling and lottery market in Ukraine. The aim of the dissertation is the theoretical and methodological substantiation of the mechanisms of state regulation of the gambling and lotteries market and the development of recommendations for their improvement and practical implementation in Ukraine. The object of the research is social relations arising in the process of state regulation of the gambling and lottery market. The subject of the study is the mechanisms of state regulation of the gambling and lottery market in Ukraine. To achieve the goal and fulfill the set tasks, the dissertation uses a set of general scientific and special methods and approaches, among them: semantic­ etymological; historical; general scientific analysis; systematization and generalization, system analysis; structural and functional; statistical, graphic, tabular, average and relative values; modeling and abstraction; dialectic, synthesis and induction; etc. In the dissertation, for the first time, a comprehensive mechanism of state regulation of the gambling and lottery market in Ukraine was developed and substantiated, which is presented as an ordered management structure of vertically and horizontally interconnected and mutually coordinated ways of influencing the object of regulation, formed in accordance with the purpose, tasks, principles and functions of state regulation, axiologically related to the positioning of the prospective state of the national market of gambling and lotteries. Such a design involves the integrative interaction of various mechanisms of state regulation (organizational­legal, financial­economic, and social­informational), which are designed to create the proper prerequisites for achieving the goal of state regulation of the gambling and lottery market in Ukraine, taking into account the public demand of society, as well as the transformational European integration vector of the development of socio­political processes in the country. The work improved: the theoretical principles of the organization of activities in the gambling and lottery market, which provide for the classification of such a market as an economic activity in the service sector, where the gambling market is a market of a special product group in terms of form ­ gambling (including the lottery), by type, belongs to the market of goods and services as a consumer market, the parameters (demand, supply, price, conjuncture, equilibrium) and attributes of which (competition, monopoly, oligopoly) are formed taking into account the influence of the state through the use of appropriate mechanisms of state regulation. As a result of the conducted research, the theoretical foundations of the policy of state regulation of the gambling and lotteries market were also improved in the context of: a) justification of the composition and structure of the gambling and lotteries market by identifying its constituent elements and systematizing their main characteristics; b) clarifying the types of social relations in the market of gambling and lotteries; c) identification of the composition and content of the mechanisms of state regulation of the gambling and lotteries market, namely: organizational­legal, financial­economic and social­informational. At the same time, the following developments were made in the dissertation work: − a conceptual and categorical apparatus in the field of public management and administration thanks to clarification of the essence of such concepts as “state regulation of the gambling and lottery market” − the influence of the state on social processes in the market of gambling and lotteries and the behavior of its participants with the aim of forming a legal and social environment that contributes to balancing the economic and social interests of all stakeholders in this area, as well as developing a consensus on the sustainable development of society; “mechanisms of state regulation of the gambling and lotteries market” − a complex of interconnected and mutually coordinated targeted ways of state influence (methods, tools, means, levers, forms, directions, etc.) on social processes in the market of gambling and lotteries in general and the behavior of its participants in particular with the aim of forming a legal and social environment that contributes to balancing economic and social interests of all stakeholders in this area, as well as developing a consensus on the sustainable development of society; − promising directions for improving mechanisms of state regulation of the gambling and lotteries market in Ukraine and tools for their implementation, taking into account national interests (in the context of modern social challenges and threats), as well as the possibility of implementing progressive foreign experience in this field.
