Незважаючи на те, що дослідження системи стримувань і противаг має багатовікову історію, у сучасній соціальній теорії та соціології політики немає єдиного комплексного підходу до дослідження цього феномена. Соціально-технологічну складову у функціонуванні системи стримувань і противаг на сьогодні вивчено недостатньо, зокрема, в межах вітчизняного соціологічного дискурсу. З погляду перспектив розвитку вітчизняної теоретичної та прикладної соціології окреслене дослідження набуває особливої актуальності, зважаючи на демократичну трансформацію політичної системи України та брак комплексних, ґрунтовних досліджень системи стримувань і противаг як запоруки утвердження стабільного демократичного соціального порядку. У вступі обґрунтовано актуальність теми, визначено мету, завдання, об’єкт і предмет дослідження, висвітлено методологічну основу роботи, наголошено на теоретичному та практичному значенні отриманих результатів, відображено попередню апробацію результатів дослідження та структуру роботи. У першому розділі «Еволюція теорії питання поділу влади» з’ясовано актуальний стан вивчення означеної проблеми, розкрито історичні етапи розвитку уявлень про систему стримувань і противаг у зарубіжній та вітчизняній соціальній науці. У другому розділі «Теоретико-методологічні засади дослідження системи стримувань та противаг як соціальної технології» досліджені сутність та технологічні особливості системи стримувань і противаг у демократичній політичній системі. У третьому розділі «Специфіка системи стримувань та противаг в Україні» проаналізовано політичні чинники еволюції форми правління в Україні, розкрито особливості функціонування системи стримувань і противаг в умовах чинності відповідних положень Конституції України, а також окреслено основні проблеми і запропоновано напрями забезпечення ефективної системи стримувань і противаг в Україні. У висновках узагальнено основні результати дослідження. Система стримувань і противаг є багатогранним феноменом. Багатовимірність феномена (а саме, горизонтальний, вертикальний, юридичний і фактичний виміри) та функції, які він виконує в суспільстві, зумовлюють інтерес до застосування інтегрального підходу до його вивчення. У роботі запропоновано власне визначення системи стримувань і противаг, демократії та демократизації. Повною мірою окреслено чинники, які впливають на функціонування системи стримувань і противаг, а також показано особливості реалізації окремих її елементів у політичних системах держав із різною формою правління. Акцентовано увагу на особливостях системи стримувань і противаг у змішаних формах республіканського правління з урахуванням політичного досвіду України. У магістерській роботі висвітлено підходи до вивчення окремих елементів системи стримувань і противаг, їхньої взаємозалежності та особливостей реалізації за різних форм правління.The problem of the relationship between the distribution of power and the process of building a democratic state is the important scientific theme in the works of foreign political analysts, scholars and politicians. Despite the fact that the study of the checks and balances system has a long history, in contemporary social theory and political sociology there are no well-grounded comprehensive approach to the study of this phenomenon. The socialtechnological component in the functioning of the system of checks and balances, is currently studied insufficiently, in particular, within the domestic sociological discourse. From the point of view to the prospects of Ukrainian theoretical and applied sociology the outlined research acquires special relevance, considering democratic transformation of political system of Ukraine and lack of complex, thorough researches of system of checks and balances as guarantees of stable democratic social order. The introduction substantiates the relevance and significance of the topic, defines the purpose, objectives, object and subject of the research, outlines the methodological basis of the work, emphasizes the theoretical and practical significance of the obtained results, reflects the preliminary approbation of the research results and structure of the thesis. The first section, «Evolution of the theory of separation of powers», clarifies the current state of this problem study, reveals the historical stages of development of ideas about the checks and balances system in foreign and domestic social science. The second section, «Theoretical and methodological principles of research of the system of checks and balances as the social technology» presents the investigation of the essence and specific of the checks and balances system in a democratic political system. The third section, «Specifics of the system of checks and balances in Ukraine» is devoted to the analysis of the political factors which determinate the forms of the government evolution in Ukraine, according to the reflection of specific of the checks and balances system in the acting Constitution of Ukraine. And the main problems and proposed ways for effective modernization of the checks and balances system in Ukraine were outlined. The conclusions summarize the main findings of the study. The system of checks and balances is a multifaceted phenomenon. However, the multidimensionality of the phenomenon (namely, horizontal, vertical, legal and factual dimensions) and the functions it plays in society determines the interest in applying an integrated approach to its study. The thesis proposes its own definition of the system of checks and balances, democracy and democratization. The factors influencing the functioning of the system of checks and balances are argued an outlined. Emphasis is placed on the peculiarities of the checks and balances system in the mixed forms of republican government, taking into account the political experience of Ukraine. The master thesis covers the approaches to the study of separate elements of the checks and balances system, their interdependence and features of their realization in different forms of government. The study is relevant due to the problem of theoretical and practical justification of the checks and balances system impact on the level of democracy of the political system. The study of the checks and balances system evolution in the context of democracy building in independent Ukraine makes it possible to find a number of effective ways to improve domestic legislation and overcome problems that hinder the effective functioning of the system. To track the natural changes in the form of government and the checks and balances system at the legal level, the study was based on the provisions of three fundamental regulations that at various stages of Ukrainian history ensured the functioning of checks and balances, namely the «Constitutional Treaty between the Verkhovna Rada of Ukraine and the President of Ukraine on the basic principles of organization and functioning of state power and local self-government in Ukraine for the period before the adoption of the new Constitution of Ukraine» of 8.06.1995, the Constitution of Ukraine of 28.06.1996 and the Law of Ukraine «On Amendments to the Constitution of Ukraine» of 8.12.2004. The practical significance of the obtained results is determined by scientific relevance; it consists in the possibility of applying the results of research for scientific and educational purposes.
