The necessity of enshrining the concept of the employee's right to self-defense of labor rights, as well as defining the methods of self-defense and the mechanism for realizing such a right in the domestic labor legislation, has been established. During the writing of the article, both general scientific methods and special legal methods were used, including the method of state-legal modeling, formal legal and comparative legal methods. When writing the article, the regulatory legal framework and judicial practice in the field of determining methods of self-protection of labor rights in such states of the European Union were studied, in particular, the experience of Germany, France, Italy, Poland, Lithuania and the Czech Republic was analyzed. The legal regulation of certain methods of self-protection of the labor rights of employees in foreign countries, such as refusal to work, which is not provided for in the labor contract, is analyzed; refusal to work, which poses a threat to the life or health of the employee; refusal to work, which will lead to violation of legislation, etc. Taking into account Based on the experience of the European Union states, it is proposed to supplement the Code of Labor Laws of Ukraine with such a method of self-defense as refusal to fulfill the obligations stipulated in the employment contract. Conclusions were made that the current labor legislation of Ukraine must be supplemented with the provision that every employee has the right to self-defense in the event of a violation of his rights or a real threat of such a violation, regardless of the possibility of further appeal to the competent authorities for the protection of his rights.У статті узагальнено законодавчий досвід країн Європейського Союзу в сфері визначення способів самозахисту трудових прав, а також розроблені на його основі пропозиції щодо вдосконалення трудового законодавства України. Встановлено необхідність у закріпленні поняття права працівника на самозахист трудових прав, а також визначення способів самозахисту та механізму реалізації такого права у вітчизняному законодавстві про працю. Під час написання статті були використані як загальнонаукові методи, так і спеціально-юридичні, серед яких метод державно-правового моделювання, формально-юридичний та порівняльно-правовий методи. При написанні статті було досліджено нормативно-правову базу та судову практику в сфері визначення способів самозахисту трудових прав у таких державах Європейського Союзу, зокрема проаналізовано досвід Німеччини, Франції, Італії, Польщі, Литви та Чехії. Проаналізовано правове регулювання окремих способів самозахисту трудових прав працівників у зарубіжних країнах, таких як відмова від роботи, яка не передбачена трудовим договором; відмова від роботи, яка становить загрозу життю або здоров’ю працівника; відмова від роботи, яка призведе до порушення норм законодавства тощо. Враховуючи На основі досвіду держав Європейського Союзу запропоновано доповнити Кодекс законів про працю України таким способом самозахисту як відмова від виконання обов’язків передбачених трудових договором.
