Соціальне право(3), 137–144.https://ir.library.knu.ua/handle/15071834/24490The article is focused on studying the features of guaranteeing universal suffrage in Ukraine. It is noted that guarantees of human and citizen’s rights and freedoms (including political ones) are divided in modern jurisdictions into two groups: general and special (legal). Special attention is paid to the dominant role of legal guarantees, which are divided by the author into regulatory and protective. The existing regulatory base for the organization and conduction of elections in Ukraine is analyzed. Based on this, specific types of regulatory and protective guarantees are determined. The author indicates on the enchainment of regulatory guarantees with specific stages of the electoral process and to specific categories of voters. Guarantees for the exercise of universal suffrage, which have a protective (security) function, include the ability to appeal the decisions of the subjects of electoral process and to establish liability for violations of electoral rights.Стаття присвячена дослідженню особливостей гарантування загального виборчого права в Україні. Зазначається, що у сучасній юриспруденції гарантії прав і свобод людини і громадянина (в тому числі й політичні) поділяють на дві групи: загальні та спеціальні (юридичні). Акцентується на домінуючій ролі юридичних гарантій, які автор поділяє на регуляторні та захисні. Аналізується наявна нормативно-правова база організації та проведення виборів в Україні. На її підставі визначаються конкретні види регуляторних та захисних гарантій. Вказується на пов’язаність регуляторних гарантій із конкретними стадіями виборчого процесу та конкретними категоріями виборців.
