Соціальне Право, (3), 183-191. https://doi.org/10.32751/2617-5967-2025-03-18УДК 349.210.32751/2617-5967-2025-03-18https://ir.library.knu.ua/handle/15071834/12239The article examines the importance of providing social support to persons who were forced to leave their place of residence through the prism of creating appropriate legislative opportunities and mechanisms for the implementation of such rights and freedoms. And one of the areas of implementation of such guarantees is the guarantees that determine the legal mechanism for the implementation of the rights provided for IDPs. It is emphasized that social guarantees are often associated with the understanding of the social security of the individual, the creation of an appropriate state of protection and stability for the individual. In the context of the study, it is proposed to investigate social guarantees for IDPs, which are the basis for the implementation of the right to social protection. Such guarantees include: 1) guaranteeing equal and impartial access of IDPs to social protection; 2) guaranteeing fair distribution of public goods among IDPs without discrimination and without granting privileges to certain persons; 3) providing various types of social payments and benefits; 4) guaranteeing the right to an adequate standard of living for IDPs; 5) guarantees of protection and defense; 6) guarantees of the right to receive appropriate social services; 7) carrying out activities that prevent the violation of the social rights of IDPs and reduce the likelihood of social risk; 8) judicial protection and ensuring the implementation of the right to legal aid. Particular attention is paid to guarantees of institutional support for IDPs and the provision of assistance in the return of IDPs to their region of residence and assistance in the restoration of housing after the resolution of the armed conflict. As a result, it was established that the formation of an effective system of social protection for IDPs requires a comprehensive approach: regulatory and legal support, interagency cooperation, involvement of civil society institutions and orientation on long-term mechanisms for the integration of displaced persons into host communities.У статті здійснено розгляд важливості надання соціальної підтримки особам, які були змушені покинути своє місце проживання, крізь призму створення для цього відповідних  законодавчих можливостей та механізмів реалізації таких прав та свобод. І одним із напрямків реалізації таких гарантій названо саме гарантії, які й  визначають юридичний механізм здійснення тих прав, які передбачені для ВПО. Наголошено на тому, що соціальні гарантії досить часто пов’язують із розумінням соціальної безпеки особистості, створенням для особи відповідного стану захищеності та стабільності. В контексті дослідження запропоновано дослідити соціальні гарантії для ВПО, які покладені в основу реалізації права на соціальний захист. До таких гарантій віднесено: 1) гарантування рівного та неупередженого доступу ВПО до соціального захисту; 2) гарантування справедливого розподілу суспільних благ між ВПО без дискримінації та без надання привілеїв тим чи іншим особам; 3) надання різного виду соціальних виплат та допомог; 4) гарантії права на достатній життєвий рівень для ВПО; 5)  гарантії охорони та захисту; 6) гарантії права на отримання відповідних соціальних послуг; 7) проведення діяльності, яка запобігає порушенню соціальних прав ВПО та зменшує ймовірність настання соціального ризик; 8) судовий захист та забезпечення реалізації права на отримання правової допомоги.  Особливу увагу  приділено гарантії інституційної підтримки ВПО та наданні допомоги у поверненні ВПО до регіону свого проживання та надання допомоги у відновлення житла після врегулювання збройного конфлікту. У підсумку, встановлено, що формування ефективної системи соціального захисту ВПО вимагає комплексного підходу: нормативно-правового забезпечення, міжвідомчої взаємодії, залучення інституцій громадянського суспільства та орієнтації на довгострокові механізми інтеграції переміщених осіб у приймаючі громади.ukinternally displaced personsocial guaranteessocial protectionrightsfreedomslegitimate interests.внутрішньо переміщена особасоціальні гарантіїсоціальний захистправасвободизаконні інтереси.Стаття
