Вісник кримінального судочинства(1), 87–92.https://ir.library.knu.ua/handle/15071834/24211The procedural activity carried out before entering information about a criminal infraction into the Unified Register of Prejudicial Inquiries is aimed not at establishing grounds for initiating an inquiry but at “advancing” to substantiate the facts of a criminal infraction through prejudicial inquiry prior to its registration. Such “advancing” is driven by urgent circumstances. Since establishing grounds for initiating a prejudicial inquiry using material research methods is prohibited by law, these grounds must be “sought” exclusively in primary sources of information about the actions, not the “criminal infraction.” The acknowledgment of the existence of grounds for initiating a prejudicial inquiry immediately entails the performance of legal proceedings. The research conducted within this article leads to the following conclusions: 1) the verification of primary data sources is carried out solely through logical (non-material) research methods; 2) the grounds for initiating a prejudicial inquiry consist of a minimal necessary set of evidence of a criminal infraction and the elements of a criminal infraction in the action reported; 3) the provisions of the Criminal Procedure Code should be “applied” when there are grounds for a prejudicial inquiry; 4) it is reasonable to remove from procedural law the prohibition on conducting procedural actions before entering information about a criminal infraction into the Unified Register of Prejudicial Inquiries.
