Scientific-practical recommendations are provided on the application of provisions governing the procedural order of investigative (search) actions that cause difficulties for practitioners. The author notes that the term “possession” in legal literature is used in two senses: 1) possession as an independent legal institution; 2) possession as one of the powers of ownership. It appears that the use of the terms “housing” and “other possession” in the same phrase in the text of the Criminal Procedure Code of Ukraine, when referring to obtaining an investigating judge’s approval to enter them, has resolved the issue that existed before the adoption of the new Criminal Procedure Code and should not lead to difficulties in their interpretation and subsequent application. One of the objectives of a search, among others, is to locate wanted persons. Moreover, investigators and prosecutors often interpreted this provision literally, which, in my opinion, is incorrect. In the context of analyzing the article, a wanted person should be understood not only as suspects listed as wanted under Article 281 of the CPC but also as individuals who have disappeared under any circumstances and are sought by law enforcement agencies.
