The correlation between the categories "incrimination" and "criminal prosecution" has been considered. The author’s position on understanding criminal prosecution in the narrow sense is defined. It is noted that prosecution, as a criminal procedural function, should be defined in a narrow sense, namely as an activity aimed at exposing a specific person of committing a criminal offense and bringing them to criminal liability or applying other measures of criminal law influence; prosecution is always a personalized activity carried out with respect to a specific person who has the status of, for example, a suspect or an accused. Prosecution, as a form of criminal prosecution, begins with the approval or drafting of an indictment by the prosecutor. The forms of implementing prosecution include: notification of suspicion; proceedings regarding a person for the application of compulsory medical measures; proceedings concerning juveniles for the application of compulsory educational measures. Розглянуто співвідношення категорій «обвинувачення» та «кримінальне переслідування». Визначено авторську позицію щодо розуміння кримінального переслідування у вузькому значенні. Додатково обґрунтовано, що обвинувачення у процесуальному розумінні є формою кримінального переслідування.
