Вісник кримінального судочинства(1).https://ir.library.knu.ua/handle/15071834/23636The scientific conclusion of the Department of Criminal Procedure and Criminalistics at the Educational and Scientific Institute of Law of Taras Shevchenko National University of Kyiv examines the constitutionality of part 6 of Article 615 of the Criminal Procedure Code of Ukraine. This provision, introduced during martial law, automatically extends pre-trial detention for up to two months without a court ruling. It is shown to violate multiple constitutional provisions (arts. 3, 8, 29, 55, 59, 63, 64, 129), European Court of Human Rights standards, and the rule of law principle by depriving individuals of guaranteed judicial protection and the right to challenge their detention. The conclusion declares this norm unconstitutional and recommends aligning it with Ukraine’s Constitution and international obligations.Науковий висновок кафедри кримінального процесу та криміналістики ННІ права КНУ імені Т. Шевченка присвячений аналізу конституційності частини шостої статті 615 КПК України, яка в умовах воєнного стану автоматично продовжує тримання під вартою до двох місяців без ухвали суду. Доведено, що така позасудова процедура протирічить низці конституційних норм (ст. 3, 8, 29, 55, 59, 63, 64, 129), міжнародним стандартам (ЄКПЛ) та принципу верховенства права, позбавляє особу гарантованого права на судовий захист і оскарження арешту. Висновок містить обґрунтування неконституційності цієї норми й рекомендації привести її у відповідність із Конституцією та міжнародними зобов’язаннями України.ukСтаття
