It is noted that an effective legal mechanism that allows ensuring the strict implementation of the provisions of the law and creating optimal conditions for the realization of subjective rights and the exercise of legal obligations of a person in general, and of a professional athlete in particular, are guarantees of their compliance and implementation. It was established that the legal guarantees of professional athletes in the field of labor are those that ensure their labor rights as employees, as well as those related to non-labor rights, however, they are determined by the specifics of their labor activity and should be related to special legal guarantees that influence the implementation by athletes other rights. At the same time, the effective result of the establishment of legal guarantees in the field of labor is the full implementation of the subjective rights granted to professional athletes and the fulfillment of the legal obligations assigned to them. On the basis of the conducted research, it was concluded that the peculiarity of the legal regulation of the labor activity of professional sportsmen is that labor-law guarantees during employment, during labor activity, and at the termination of employment relations, although from a legal point of view, are fully extended to sportsmen, but in practice due to the closedness of the sports sphere, they have a limited arsenal of means of implementing the right to work compared to the general order, and are also distinguished by specificity, for example, the decision to enter into a contract is based not only on passing an interview, tests, but also on practical monitoring over a long period of time of skills and abilities potential employee. It is advisable to divide labor-law guarantees of professional athletes into the following groups: guarantees related to entering into employment relations; guarantees during employment; guarantees due to termination of employment.Стаття присвячена дослідженню особливостей юридичних гарантій захисту прав спортсменів у сфері праці, розкриттю їх сутності і значення. Зазначено, що дієвим правовим механізмом, що дозволяє забезпечити неухильне виконання приписів законодавства та створити оптимальні умови для реалізації суб’єктивних прав і здійснення юридичних обов’язків професійного спортсмена є гарантії їх дотримання та виконання. Констатовано, що юридичними гарантіями професійних спортсменів у сфері праці є ті, якими забезпечуються їх трудові права як працівників, та, які стосуються нетрудових прав, проте зумовлені специфікою їх трудової діяльності й повинні відноситися до спеціальних юридичних гарантій, які здійснюють вплив на реалізацію спортсменами інших своїх прав. При цьому ефективним результатом установлення юридичних гарантій у сфері праці є повне забезпечення реалізації наданих професійним спортсменам суб’єктивних прав та виконання покладених на них юридичних обов’язків. На підставі проведеного дослідження, зроблено висновок, що особливістю правового регулювання трудової діяльності професійних спортсменів є те, що трудо-правові гарантії при працевлаштуванні, під час трудової діяльності, при припиненні трудових відносин хоча й з правової точки зору повноцінно розповсюджуються на спортсменів, але на практиці в силу замкнутості спортивної сфери мають обмежений арсенал засобів реалізації права на працю порівняно із загальним порядком, а також вирізняються специфікою, приміром, прийняття рішення про укладення контракту базується не лише на проходженні співбесіди, тестувань, а й на практичному відстеженні протягом тривалого часу навичок і вмінь потенційного працівника.
