Юридичні науки, 124(5), 37–42. https://doi.org/10.17721/1728-2195/2022/5.124-610.17721/1728-2195/2022/5.124-6https://ir.library.knu.ua/handle/15071834/19900The scientific methods of analysis and synthesis, comparison, specification and generalization are used; a number of the researches, particularly, the form of ownership of the territories and objects of the nature reserve fund of Ukraine is researched as the form of ownership of the land field that constitutes the given territory and objects, namely depending on the function of the territories and objects of the nature reserve fund; the state, communal, and private forms of ownership are pointed out. The regime, admissibility, and limits of economic activity determined by legislation, particularly by the regime of territories and objects of the nature reserve fund are considered. IT has been investigated that economic activity is allowed within the territories or objects of the nature reserve fund, but only within those that will not negatively affect the condition of such territories and objects or prevent the exercising of their functions. It was established that according to the criterion of admissibility of economic activity, the territories and objects of the nature reserve fund are divided into those in which economic activity is permissible (some zones of biosphere reserves, national nature parks, etc.) and in which economic activity is not permissible at all (natural reserves, protected zone of biosphere reserves, etc.). It was analyzed in what forms the declarative principle of economic activity within the territories and objects of the nature reserve fund is implemented, in particular, the fact that, according to this principle, it is required to obtain permission documents for any economic activity by the business entity. The research resulted in presenting the examples of types of economic activity within the territories and objects of the nature reserve fund and in proposing the number of changes to the legislation.За допомогою наукових методів аналізу і синтезу, порівняння, конкретизації та узагальнення досліджено форму власності на території та об'єкти природно-заповідного фонду України, під якою розуміється форма власності на земельну ділянку, яка залежно від цільового призначення є державною, комунальною чи приватною формою власності. Розглянуто порядок, допустимість та межі господарської діяльності, які визначаються законодавством і зокрема режимом територій та об'єктів природно-заповідного фонду. Досліджено, що на територіях чи об'єктах природно-заповідного фонду допускається господарська діяльність, однак лише така, яка не впливатиме негативно на стан цих територій та об'єктів або перешкоджати їх використанню за цільовим призначенням. Встановлено, що за критерієм допустимості здійснення господарської діяльності території та об'єкти природно-заповідного фонду поділяють на такі, де допустима господарська діяльність (деякі зони біосферних заповідників, національних природних парків тощо), а де не допустима господарська діяльність (природні заповідники, заповідна зона біосферних заповідників тощо). Проаналізовано, у яких формах реалізується декларативний принцип здійснення господарської діяльності на територіях і об'єктах природно-заповідного фонду, за яким принципом передбачається обов'язковість отримання дозвільних документів для здійснення тої чи іншої господарської діяльності суб'єктом господарювання.
