Соціальне Право, (3), 197-203. https://doi.org/10.32751/2617-5967-2025-03-20УДК 342.710.32751/2617-5967-2025-03-20https://ir.library.knu.ua/handle/15071834/12241The article analyses the right to judicial protection in Northern Cyprus, examining its constitutional foundations, the structure and functioning of its de facto judicial system, and the profound impact of the ongoing military conflict and the unrecognised international status of the Turkish Republic of Northern Cyprus (TRNC). The aim of the study is to draw on the experience of a state that, while in a state of war and post-war period, implements the right of citizens to judicial protection. The study is based on a systematic method of analysing primary legal documents, such as the TRNC Constitution, decisions of international courts, reports of international organisations (including the UN, the European Union, Freedom House and the US State Department), as well as scientific publications and information from official TRNC sources. Comparative legal and historical methods were used in the study, which made it possible to trace the evolution of the judicial system and compare it with internationally recognised standards. The method of generalisation was used to identify and analyse key decisions of the ECHR on the Cyprus issue. The pragmatic approach adopted by international bodies, in particular the European Court of Human Rights (ECHR), in assessing the legal framework of the TRNC, especially with regard to property rights and human rights guarantees, was examined. The article highlights the internal tension between constitutional guarantees and practical challenges, including issues of judicial independence, prison conditions and government transparency, which are exacerbated by international isolation and external political influence. The article presents key conclusions and practical recommendations aimed at strengthening judicial protection and access to justice in this unique geopolitical context.У статті проаналізовано права на судовий захист у Північному Кіпрі, досліджуючи його конституційні основи, структуру та функціонування його де-факто судової системи, а також глибокий вплив тривалого військового конфлікту та невизнаного міжнародного статусу Турецької Республіки Північного Кіпру (ТРПК). Метою дослідження є використання досвіду держави, яка перебуваючи у стані війни та поствоєнному періоді реалізує право громадян на судовий захист. Дослідження базується на системному методі шляхом аналізу первинних правових документів, таких як Конституція ТРПК, рішень міжнародних судів, звітів міжнародних організацій (включно з ООН, Європейським Союзом, Freedom House та Держдепартаментом США), а також наукових публікацій та інформації з офіційних джерел ТРПК. Під час дослідження було застосовано порівняльно-правовий та історичний методи, що дозволило прослідкувати еволюцію судової системи та порівняти її з міжнародно визнаними стандартами. Метод узагальнення був використаний для виокремлення і аналізу ключових рішень ЄСПЛ щодо Кіпрського питання. Вивчено прагматичний підхід, прийнятий міжнародними органами, зокрема Європейським судом з прав людини (ЄСПЛ), при оцінці правової бази ТРПК, особливо щодо прав власності та гарантій прав людини. Стаття висвітлює внутрішню напругу між конституційними гарантіями та практичними викликами, включаючи питання судової незалежності, умов утримання у в'язницях та урядової прозорості, що посилюються міжнародною ізоляцією та зовнішнім політичним впливом.
