Соціальне право(1), 121–128. https://doi.org/10.37440/soclaw.2021.01.1910.37440/soclaw.2021.01.19https://ir.library.knu.ua/handle/15071834/24789The focus of the article is to develop an up-to-date scientific thought about a complex of general and special guarantees for the protection of the right to financial provision of military personnel in accordance with the norms of the current legislation of Ukraine. The author qualified the general social guarantees for the protection of the servicemen’s right to financial security as follows: economic guarantees (state funding of institutions for the protection of the servicemen’s rights; the amount of a serviceman’s remuneration secured by the Government); political guarantees (political and legal support for the development of the state as a legal and democratic one; creating conditions for the further development of social state); ideological guarantees (cultivation of intolerance towards violation of the servicemen’s labor rights; the formation of a public request to maximize the efforts of the state to ensure the proper functioning of the mechanism for protecting the serviceman’s rights to a decent remuneration). Special social guarantees for the protection of the servicemen’s right to financial security include regulatory and legal guarantees (enshrined in the legislation of the following ones: the right to remuneration, the grounds and conditions of financial security; the procedure for financial provision; determination of the state's obligations to ensure the right to financial security, etc.); institutional guarantees (human rights protection activities of the court; human rights protection activities of leaders in military service). To summarize the article, it is noted that the guarantees under study are a special manifestation of guarantees for protecting the employee's right to remuneration and provide for the functioning of a legal mechanism for protecting the rights of a serviceman to a decent remuneration, covering general and special guarantees for protecting the workers’ rights. The purpose of this mechanism is to create and maintain at the proper level optimal institutional, organizational and other conditions under which a serviceman can confirm and protect the right to the monetary allowance by all means and methods available to him, without endangering the state of national security of Ukraine.Метою статті є формування актуальної наукової думки про комплекс загальних і спеціальних гарантій захисту права на грошове забезпечення військовослужбовців у відповідності до норм чинного законодавства України. До загально-соціальних гарантій захисту права на грошове забезпечення військовослужбовців автором відносяться: економічні гарантії (державне фінансування інститутів захисту прав військовослужбовців; закріплення Урядом розміру винагороди військовослужбовця); політичні гарантії (політико-правове забезпечення розвитку держави в якості правової та демократичної держави; створення умов для подальшого розвитку соціальної держави); ідеологічні гарантії (культивування нетерпимості до порушення трудових прав військовослужбовців; формування суспільного запиту щодо максимізації зусиль держави стосовно забезпечення належного функціонування механізму захисту права військовослужбовця на достойну винагороду). Спеціально-соціальні гарантії захисту права на грошове забезпечення військовослужбовців охоплюють: нормативно-правові гарантії (закріплення в законодавстві: права на винагороду, підстав і умов грошового забезпечення; порядку грошового забезпечення; визначення обов’язків держави щодо забезпечення права на грошове забезпечення тощо); інституційні гарантії (правозахисна діяльність суду; правозахисна діяльність керівників на військовій службі). У висновках до статті зазначається, що досліджувані гарантії є спеціальним виявом гарантій захисту права працівника на винагороду й передбачають функціонування правового механізму захисту права військовослужбовця на гідну винагороду, що охоплює загальні та спеціальні гарантії захисту прав працівників. Метою цього механізму є створення та підтримання на належному рівні оптимальних інституційно-організаційних та інших умов, за яких військовослужбовець може підтвердити та захистити право на грошове забезпечення усіма доступними для нього засобами і способами, що не ставлять під загрозу стан національної безпеки України.ukKey words: military servicemilitary personnelfinancial supportwagesprinciplesemployee.Ключові слова: військова службавійськовослужбовецьгрошове забезпеченнязаробітна платаознакипрацівник.Стаття
