The study examines the evolution of the normative legal framework governing intellectual property issues, taking into account the specific features of the soviet period and the transformations associated with Ukraine’s attainment of independence. A key emphasis is placed on the development of normative legal documents concerning the legal protection of trademarks following Ukraine’s independence. The paper characterizes the particular impact that the implementation of international documents has had on the substantive content of regulatory instruments. It is noted that the most recent phase of legislative development is accompanied by the harmonization of national legislation with the provisions of the acts of the European Union. The research substantiates the necessity of adapting legislation to the demands of the modern globalized market, which contributes both to enhancing the legal protection of the interests of trademark owners and to stimulating the competitiveness of the economy. The methodological framework of the study is based on a comprehensive approach that combines historical-legal analysis, comparative methods, and an examination of the practical application of normative legal acts. The analysis enables the identification of the principal problematic aspects of legal application in the field of trademark protection and outlines the prospects for modernizing the administrative-legal mechanism. The obtained results indicate the need for continuous improvement of the legislative framework and the implementation of modern technological solutions in the processes of registration and administration, which will ensure more effective protection of intellectual property rights. The research holds practical significance for the development of recommendations for further reforms in the field of intellectual property, aimed at integration into the global legal system and the promotion of stable economic growth.Стаття присвячена аналізу історико-правових процесів формування та розвитку механізмів охорони торговельних марок в Україні в умовах інтеграції національної правової системи до міжнародних стандартів. У роботі проаналізовано еволюцію нормативно-правової бази, що регулює питання інтелектуальної власності, з урахуванням особливостей радянського періоду та трансформацій, пов’язаних із здобуттям незалежності. Ключовий акцент здійснено на розробці нормативно-правових документів з питань правової охорони торговельних марок після набуття Україною незалежності. Охарактеризовано особливості впливу імплементації міжнародних документів на змістовне наповнення регламентуючих документів. Відзначено, що новітній етап розвитку законодавства супроводжується гармонізацією національного законодавства з положеннями актів Європейського Союзу. Наукове дослідження обґрунтовує необхідність адаптації законодавства до вимог сучасного глобалізованого ринку, що сприяє як посиленню правового захисту інтересів власників, так і стимулює конкурентоспроможність економіки. Методологічна база дослідження ґрунтується на комплексному підході, що поєднує історико-правовий аналіз, порівняльний метод та аналіз практики застосування нормативно-правових актів. Проведений аналіз дозволяє визначити основні проблемні аспекти правозастосування у сфері охорони торговельних марок, а також окреслити перспективи модернізації адміністративно-правового механізму. Отримані результати вказують на необхідність постійного вдосконалення законодавчої бази та впровадження сучасних технологічних рішень у процеси реєстрації та адміністрування, що забезпечить більш ефективний захист прав інтелектуальної власності.
