The author considers the regulations of this issue and the practice of the European Court of Human Rights, which interferes in the private residence of a lawyer under Art. 8 European Convention on Human Rights. Based on studies of the case law of the European Court of Human Rights and the legislation of Ukraine, problems and gaps have been identified in conducting searches of a lawyer's home and premises, as well as in the mechanism of ensuring the individual's conventional right to respect for housing in general. The author draws conclusions about the necessary legal guarantees of lawyer confidentiality and the problem of its implementation.Стаття присвячена сутності і кордонам конфіденційності адвокатської діяльності у системі правосуддя. Автор розглядає нормативну регламентацію даного питання і практику Європейського суду з прав людини стосовно меж втручання у приватне житло адвоката у рамках ст. 8 Європейської конвенції з прав людини. На підставі досліджень практики ЄСПЛ та законодавства України виявлені проблеми та прогалини у проведенні обшуків житла адвоката та приміщень, де він здійснює адвокатську діяльність, а також у механізмі забезпечення конвенційного права особи на повагу до житла в цілому.
