Автором на підставі критичного аналізу сутності понять «правовий механізм», а також «реалізація прав осіб з інвалідністю у сфері трудових відносин» формулюється визначення поняття «правовий механізм реалізації прав осіб з інвалідністю у сфері трудових відносин». Встановлюється перелік основних особливих рис досліджуваного правового механізму, як механізму, для якого властивим є те, що він: є багатозначним соціально-правовим явищем; концептуальним чином підпорядкований доктрині соціальної держави; спрямований на створення сприятливих умов для ефективної об’єктивації мети реалізації прав осіб з інвалідністю в трудових відносинах; виконує комплекс завдань (втілення в практичній дійсності стандартів гармонійної стабільності трудових правовідносин, а також стандартів концепції гідної праці; реалізація заходів повної та продуктивної зайнятості осіб з інвалідністю тощо); охоплений державною політикою щодо осіб з інвалідністю; в своєму вияві зумовлює специфічний соціально-правовий ефект, який позначається на суспільстві та державі.The article is devoted to the formation of an actual scientific thought about the conceptual essence of the legal mechanism for the realization of the rights of persons with disabilities in the field of labor relations. Based on a critical analysis of the essence of the concepts of “legal mechanism”, as well as “realization of the rights of persons with disabilities in the field of labor relations”, the author formulates the definition of “legal mechanism for the realization of the rights of persons with disabilities in the field of labor relations”.
