Because in the extremely difficult conditions of the war, thousands of enterprises, despite the security risks, continue to work. Their work is the basis of Ukraine's economic stability and is more important than ever. And today, more than ever, the employer faces the obligation to ensure safe working conditions at enterprises, institutions, and organizations in accordance with the law. The purpose of the article is to study current issues of labor safety of workers in the conditions of martial law. Since the constitutional right of everyone to proper, safe and healthy working conditions belongs to the basic rights in the field of work, the normative support of which is carried out both by international legal acts of the UN, ILO, Council of Europe, European Union, and by acts of national legislation. Having analyzed scientific sources, normatively - legal acts, statistical data in the field under consideration, it was concluded that work in wartime, especially in the territories where hostilities are taking place, is associated with a large number of new risks, including fatal ones, which lead to the deterioration of working conditions in all branches of the economy. Therefore, all enterprises, institutions and organizations are obliged to create working conditions for their employees in which their lives and health are not exposed to risks. That is, employers have the responsibility to ensure safe working conditions and the introduction of modern technical safety equipment. This includes working out the safety of technological processes, the serviceability of machines, mechanisms, equipment and other means of production, control of the condition of the working capacity of the means of collective and individual protection used by employees. Attention is drawn to the fact that the development and approval of draft laws on the safety and health of workers is important in the direction of improving the standards of safety and health of workers, as it opens the door to European standards of safety and health of workers at the workplace.Сьогодні особливого вирішення потребують питання охорони праці та дотримання безпеки праці працівників в умовах воєнного стану. Оскільки у надважких умовах війни тисячі підприємств, незважаючи на безпекові ризики, продовжують працювати. Їх робота є основою економічної стабільності України і як ніколи важлива. І сьогодні перед роботодавцем, як ніколи постає обов’язок щодо забезпечення відповідно до законодавства безпечних умов праці на підприємствах, в установах, організаціях. Метою статті є дослідження актуальних питань безпеки праці працівників в умовах воєнного стану. Оскільки конституційне право кожного на належні, безпечні і здорові умови праці належить до основних прав у сфері праці, нормативне забезпечення якого здійснюється, як міжнародно-правовими актами ООН, МОП, Ради Європи, Європейського Союзу, так і актами національного законодавства Проаналізувавши наукові джерела, нормативноправові акти, статистичні дані в розглядуваній царині, було зроблено висновок, що робота у воєнний час, тим паче на територіях, де ведуться бойові дії, пов’язана з великою кількістю нових ризиків, зокрема смертельних, що призводять до погіршення умов праці в усіх галузях економіки. Відтак всі підприємства, установи та організації зобов'язані створювати умови праці для своїх працівників, за яких їхнє життя та здоров'я не піддається ризикам. Тобто на роботодавців покладено обов’язок за забезпечення безпечних умов праці та впровадження сучасних засобів технічної безпеки. Це містить у собі опрацювання безпеки технологічних процесів, справність машин, механізмів, устаткування та інших засобів виробництва, контроль працездатності стану засобів колективного та індивідуального захисту, що використовуються працівниками.
