Вісник кримінального судочинства(4), 128–136.https://ir.library.knu.ua/handle/15071834/23980In the article the author attempted to formulate a question about the formation of Ukraine’s investment attractiveness through the prism of judicial protection. It has been established that studies related to investment, investment attractiveness and the creation of a favorable investment climate were first and foremost studied in the field of finance, economics, management, banking, and legal science was not systematically explored. But in recent years there has been a tendency for the judicial system to be investigated in terms of the investment attractiveness of our country for foreign investors. It is concluded that the effectiveness of attraction of long-term productive investments of money, creative energy, physical and spiritual forces in our country is influenced by such fears of potential investors as a high probability of unexpected obstacles by the competent authorities of the state, a high level of possible risks linked to an unstable situation in our country), violation of the rights of people and business, etc. All this is compounded by the too low level of trust of citizens and the international community in the judicial and law-enforcement (human rights) system, uncertainty in the protection of their property and future investments, etc. The author analyzes the relationship and place of the judiciary in the system of complex measures to increase the investment attractiveness of Ukraine. Based on the study of international legal standards, the analysis of the reports of international organizations and experts, an analysis of the organizational and legal problems of the judiciary in Ukraine, it has been established that only an effective judicial system can be one of the ways of attracting potential investments into the development of our statehood. It is argued that the vectors for improving the judiciary in order to increase the investment attractiveness of Ukraine should be the establishment of international community trust in the judicial system of Ukraine (through the establishment of the principle of mutual trust between judicial systems), the establishment of trust of Ukrainian citizens in the judiciary, elimination of corruption component in the activities of judicial bodies and enforcement Ukraine’s international obligations in the field of human rights protection. Areas of mutual trust between judicial systems are analyzed, among which it is proposed to allocate: 1) modernization of judicial policy, which provides for the formation of judicial power as a mechanism for reconciliation of private and public interests, including transnational ones; 2) mutual recognition of court decisions; 3) formation of a single legal space by means of globalization and informatization of the judiciary; 4) the gradual development of a European judicial culture based on the diversity of legal systems and unity through European law. It is proved that the formation of Ukraine’s investment attractiveness for foreign partners and potential investors is extremely important, and the judiciary is able to become a worthy guarantee in the mechanism of protection of investors’ rights, subject to overcoming of the specified organizational and legal problems.У статті автор спробувала сформулювати постановку питання щодо становлення інвестиційної привабливості України через призму судового захисту. Встановлено, що дослідження, пов’язані з інвестиціями, інвестиційною привабливістю та створенням сприятливого інвестиційного клімату, передусім були предметом вивчення науковців у сфері фінансів, економіки, менеджменту, банківської справи, а юридичною наукою системно не досліджувалися. Але останніми роками простежується така тенденція, що судову систему досліджують з погляду інвестиційної привабливості нашої країни для іноземних інвесторів. Робиться висновок, що на результативність залучення довгострокових продуктивних інвестицій грошових коштів, творчої енергії, фізичних та духовних сил на території нашої країни впливають такі побоювання суб’єктів-можливих інвесторів, як висока імовірність неочікуваних перешкод з боку компетентних органів держави, високий рівень можливих ризиків (пов’язаний із нестабільною ситуацією у нашій країні), порушення прав людей та бізнесу тощо. Усе це посилюється і занадто низьким рівнем довіри громадян та міжнародної спільноти до судової та правоохоронної (правозахисної) системи, невпевненість у захисті своєї власності та майбутніх інвестицій тощо. У роботі авторкою проаналізовано взаємозв’язок та місце судової влади у системі комплексних заходів щодо підвищення інвестиційної привабливості України. На базі вивчення міжнародно-правових стандартів, аналізу доповідей міжнародних організацій та експертів, аналізу організаційно-правових проблем судової влади в Україні встановлено, що лише ефективно діюча судова система може бути одним із шляхів залучення потенційних інвестицій у розвиток нашої державності. Аргументовано, що векторами удосконалення судової влади для підвищення інвестиційної привабливості України мають бути становлення довіри міжнародної спільноти до судової системи України (шляхом становлення принципу взаємної довіри між судовими системами), становлення довіри громадян України до судової влади, викорінення корупційної складової у діяльності судових органів та виконання Україною міжнародних зобов’язань у сфері захисту прав людини. Проаналізовано напрями становлення взаємної довіри між судовими системами, серед яких запропоновано виділяти: 1) модернізацію судової політики, яка передбачає становлення судової влада як механізму узгодження приватних та суспільних інтересів, в тому числі й транснаціональних; 2) взаємне визнання судових рішень; 3) становлення єдиного правового простору шляхом глобалізації та інформатизації судової влади; 4) поетапний розвиток європейської судової культури, заснованої на різноманітності правових систем та єдності через європейське право. Доведено, що становлення інвестиційної привабливості України для іноземних партнерів та потенційних інвесторів є вкрай важливим, а судова влада спроможна стати гідною гарантією в механізмі захисту прав інвесторів за умови подолання зазначених організаційно-правових проблем.ukjudicial powerjudicial systemtrust in courtauthority of courtinvestment attractiveness.судова владасудова системадовіра до судуавторитет судуінвестиційна привабливість.Стаття
