By defining the concept of “social protection of judges in Ukraine”, the author concludes that this guarantee of judicial independence is distinguished by several unique characteristics. This type of protection concerns an employee with a special labor law status, namely, a judge holding legalstatus (also a retired judge), and, on the other hand, members of their family. A special legal framework protects judges in Ukraine. This is interpreted in light of the judicial positions of the Constitutional Court of Ukraine regarding judges' status and the need to ensure social security for such employees. This framework serves as the regulatory ground for social protection measures, provided factual and procedural grounds exist for them. The social protection of judges in Ukraine includes additional social guarantees that compensate for the restrictions, prohibitions, and risks inherent in their work, rather than personal privileges for judges. Furthermore, it is the state's responsibility to ensure a judge's social protection, which is of the utmost social and legal significance for individuals, society, and the state. Separately, attention is drawn to the fact that the social protection of judges in Ukraine involves the creation and operation of a legal mechanism for the social protection of judges. The article outlines promising areas for further research on the issues of the social protection of judges in Ukraine.Стаття присвячена з’ясуванню основних ознак соціального захисту суддів в Україні. Встановлюючи сутнісний зміст поняття «соціальний захист суддів в Україні» автор доходе думки, що ця особлива гарантія незалежності та самостійності суддів характеризується рядом особливих ознак. Цей вид захисту, з одного боку, стосується працівника зі спеціальним трудоправовим статусом, а саме того, що володіє правовим статусом судді (також судді у відставці), а з іншого боку – членів його сім’ї. Соціальний захист суддів в Україні ґрунтується на особливій нормативно-правовій основі (тлумачаться з урахуванням правових позицій Конституційного Суду України, що стосуються статусу суддів і потреби забезпечення соціальної безпеки таких працівників), яка є нормативною підставою соціального захисту, що застосовується за наявності для цього фактичних і процедурних підстав. Для соціального захисту суддів характерним є також те, що ним охоплено комплекс додаткових соціальних гарантій, що не є особистим привілеєм судді, а заходом компенсування обмежень, заборон і ризиків, якими характеризується робота судді. Крім того, соціальний захист судді – це важливий обов’язок держави, виконання якого має надзвичайне соціально-правове значення для індивіда, суспільства та держави. Окремо звертається увага на те, що соціальний захист суддів в Україні передбачає створення і дію правового механізму соціального захисту суддів.
