Проаналізовані позиції законодавця та суду по зарахуванню періоду роботи до пільгового стажу, запропоновані відповідні зміни по вдосконаленню законодавстваThe article describes problem issues of workplace certification for employees working in bad working conditions; the procedure of work period determination giving a right for pension awarding under preferential conditions is examined for employees working in bad working conditions. Employers do not always faithfully take their obligations on periodic workplace certification concerning work conditions because the confirmation of bad working conditions in accordance with certification results gives a right to employee for preferential conditions of pension awarding, namely a pension from an earlier age. Certification of workplace with bad working conditions is not beneficial for employer because amount of pension received during the period of pension from earlier age until the employee achieves generally established retirement age should be indemnified by employer to Pension Fund of Ukraine. Thus employers avoid workplace certification that causes problems to the employee for confirmation of legal fact of work in bad conditions. The attitude of lawmakers and court concerning work period inclusion into preferential work period are analyzed. Court practice is ambiguous, in particular, there are two key positions: the first one is that violation of legislation by the employer should not create negative consequences for the employee to exercise a right for pension provision (such attitude is supported by the author of this article) and the second one is the lack of established law for the confirmation of the law fact on work in bad working conditions does not give a right for employee to receive pension under preferential conditions. Today current legislation governs legal relationships in the filed mentioned above in such a way that there is a situation when a possibility of acquiring right by employee to receive pension according to the age under preferential conditions depends on not only under which conditions and which position a person holds, but also on whether employer conducts certification or not. And, even, if a person has actually work period under bad working conditions but it is not confirmed by this certification, he loses a right for early pension awarding. There are considerations that except certification it is possible to determine that the person had working period under bad working conditions using paragraph 20 of Regulations on confirmation of existing working period for pension awarding in case of absence of labor book or appropriate records in it, namely giving clarifying references. To encourage employers for timely workplace certification the following relative changes on law improvement are proposed: To bind legally employers to indemnify in double amount to Pension Fund of Ukraine expenses on payment and delivery of pensions according to the age under preferential conditions that are awarded taking into account working period under bad working conditions that is confirmed not by certification results (from 21.08.92) but in other ways.
