The article examines the main social risks faced by judges and their impact on social security. It places an emphasis on ensuring proper working and living conditions for judges during their secondment, as well as on the legal mechanisms that guarantee their social security. The article notes the absence of a single supranational act within the European Union that regulates the social protection of judges during secondment, underscoring the relevance of analyzing legal regulation in specific EU member states. The article explores the advantages and disadvantages of the approaches taken by the Czech Republic and Poland regarding the social protection of judges, particularly in the fields of housing, transportation cost compensation, and daily allowances. In the Czech Republic, social protection of judges during and in connection with a secondment is ensured through several guaranteed rights. Judges have the right to housing at the location of the court to which they are temporarily sent. They are also entitled to compensation for using a nonofficial road vehicle for travel from their place of residence to the temporarily assigned court and back, provided there is consent. Additionally, judges have the right to reimbursement of confirmed travel expenses from their place of residence. In Poland, social protection of judges during and in connection with a secondment is ensured through the guarantee of several rights. Judges have the right to free accommodation at the place of secondment, in conditions appropriate to the position held, or to reimbursement for living expenses there. They are entitled to reimbursement of expenses for the first trip from their place of permanent residence to the place of secondment, as well as for the last trip back to the place of permanent residence, including reimbursement of other travel expenses. Additionally, judges receive a one-time benefit to cover the cost of local transport. They also have the right to daily allowances for secondment, which cover expenses for food and other minor costs incurred during the secondment. Furthermore, judges can claim reimbursement for using vehicles for business purposes and for daily travel to the place of secondment. The conclusions of the article summarize the results of the scientific research, highlighting the effectiveness of these measures in ensuring the welfare and efficiency of judges on secondment.Стаття присвячена аналізу правового регулювання соціального захисту суддів у Чеській Республіці та Республіці Польща під час та у зв’язку із їх відрядженням. Розглядаються основні соціальні ризики, з якими наразі стикаються судді, та їхній вплив на соціальну безпеку. Зроблено акцент на забезпеченні належних умов праці та проживання суддів під час відряджень, а також на правових механізмах, що гарантують їх соціальну безпеку. У статті констатується відсутність єдиного наднаціонального акту Європейського Союзу, який би врегульовував соціальний захист суддів під час відряджень, що робить актуальним аналіз правового регулювання у конкретних державахчленах ЄС. Досліджуються переваги та недоліки підходів Чехії та Польщі до соціального захисту суддів, зокрема у сфері житлового забезпечення, компенсації транспортних витрат та добових виплат. Зокрема, у Чехії соціальний захист суддів під час та у зв'язку із відрядженням забезпечується шляхом гарантування здійснення суддями таких прав: право на житлове забезпечення в місці розташування суду, до якого суддя був тимчасово направлений; право судді на компенсацію за користування неслужбовим дорожнім транспортним засобом для проїзду від місця проживання до суду, до якого він був тимчасово приписаний, і назад, якщо є згода; право на відшкодування підтверджених витрат на проїзд від місця. Натомість, у Польщі соціальний захист суддів під час та у зв'язку із відрядженням забезпечується шляхом гарантування здійснення суддями наступних прав: право на безкоштовне проживання у місці відрядження в умовах, що відповідають займаній посаді, або на відшкодування витрат на проживання в місці відрядження; право на відшкодування витрат на перший проїзд від місця постійного проживання до місця відрядження, відшкодування витрат на останній проїзд від місця відрядження до місця постійного проживання та відшкодування витрат на проїзд; право на отримання одноразової допомоги на покриття витрат на проїзд у місцевому транспорті; право на отримання добових виплат за відрядження, що призначаються судді для покриття ним витрат на харчування та інші дрібні витрати, які він може зазнати у відрядженні; право на відшкодування витрат на використання у службових цілях транспортних засобів; право на відшкодування витрат на щоденний проїзд до місця виконання роботи у відрядженні.
