С. 39-41.УДК 368:369https://ir.library.knu.ua/handle/15071834/5439В статті досліджуються умови, за яких подія може бути визнана нещасним випадком на транспорті; аналізуються ключові категорії: «час обслуговування поїздки» та «нещасний випадок на транспорті», розглядається судова практика, виокремлюються спільні та відмінні риси нещасного випадку із водієм на транспорті та нещасного випадку на виробництві.The article concludes that accidents at work and accidents with a driver on a vehicle are related to both general and partial; an accident with the driver on the vehicle is a kind of accident at work and has increased material security, since the victim receives an insurance sum in the insurance case - an accident in transport regardless of payments on state social insurance, social security and the order of compensation of losses. It is also determined that the time of service of a trip is the length of departure for somewhere for a short time during which work is performed, functions related to the satisfaction of their requests, needs. It is necessary to distinguish between the concept of "time of service of a trip" and "call service time" (for employees of medical teams), since in the time the given concepts are not completely identical: the time of service of a trip is part of the time of call maintenance. Since the driver is insured only for the duration of the service of the trip, and the trip is inextricably linked to the transport on which it is carried out, it is obvious that an accident in transport can not be considered as if there is no causal link between transport and an accident. Trial practice in case of compensation for damage caused by an accident in transport confirms the correctness of the drafting of an accident on transport even if the health damage occurred in the vehicle from contact with other things, which was facilitated by the movement of the vehicle.
