The article is devoted to the study of distinguishing the elements of the mechanism of administrative and legal protection of public interests in the activities of institutional investors. The purpose of the article is scientifically based identification of the elements of the mechanism of administrative and legal protection of public (public) interests in the activities of institutional investors. The author emphasizes that the mechanism of protection of public interests should not be identified with the mechanism of public management of the activities of institutional investors since it should cover only the spectrum of phenomena and processes designed to protect the established legal order in this area and respond to any encroachments on it by various sub-entities due to the mismatch of interests of different parties of the public administration system. To the elements of the mechanism of administrative and legal protection of public interests in the activities of institutional investors, the author proposes to include a complex of specific forms and methods of management activity, administrative tools, and administrative procedures aimed at: preventing the emergence of contradictions between the elements of the public management system of the activities of institutional investors, which may affect the public interests (including through the improvement of regulatory norms and regulatory aspects of the general management system) of citizen-investors; prevention of contradictions between the elements of the public administration system, which may affect (create risks or lead to) violation of public interests (citizen-investors); response to contradictions (their termination) that arose between the elements of the system of public management of the activities of institutional investors, which led to a violation of the public interests of citizen-investors; bringing to legal responsibility for offenses that led to the violation of the public interests of citizen-investors; restoration of public interest, rights, freedoms, and legitimate interests of citizenАнотація. Стаття присвячена дослідженню питання виокремлення елементів механізму адміністративно-правової охорони суспільних інтересів в діяльності інституційних інвесторів. Метою статті є науково обґрунтоване виокремлення елементів механізму адміністративно-правової охорони суспільних (публічних) інтересів в діяльності інституційних інвесторів. Автор наголошує, що механізм охорони суспільних інтересів не слід ототожнювати з механізмом публічного управління діяльністю інституційних інвесторів, оскільки він повинен охоплювати лише спектр явищ та процесів, що покликані охороняти встановлений правопорядок в цій сфері та реагувати на будь-які посягання на нього з боку різних суб’єктів через неспівпадіння інтересів різних сторін системи публічного управління. До елементів механізму адміністративно-правової охорони суспільних інтересів в діяльності інституційних інвесторів автор пропонує відносити комплекс певних форм та методів управлінської діяльності, адміністративних інструментів та адміністративних процедур, спрямованих на: а) запобігання виникненню суперечностей між елементами системи публічного управління діяльністю інституційних інвесторів, які можуть вплинути на суспільні інтереси (у тому числі через вдосконалення регулятивних норм і регулятивних елементів системи публічного управління) громадян-інвесторів; б) попередження виникнення суперечностей між елементами системи публічного управління, які можуть вплинути (створити ризики чи призвести) до порушення суспільних інтересів (громадян-інвесторів); в) реагування на суперечності (їх припинення), які виникли між елементами системи публічного управління діяльністю інституційних інвесторів, що призвели до порушення суспільних інтересів громадян-інвесторів; г) притягнення до юридичної відповідальності за правопорушення, що призвели до порушення суспільних інтересів громадян-інвесторів; д) відновлення суспільного інтересу, поновлення прав, свобод та законних інтересів громадян – інвесторів.ukinstitutional investorprotection of public interestmechanismpublic administration.інституційний інвесторохорона суспільного інтересумеханізмпублічне управління.Стаття
